PARTIAL RELEASE OF MORTGAGE
THIS PARTIAL RELEASE OF MORTGAGE is given this /711 day of December, 200S by FIRST
NATIONAL BANK OF ST. LOUIS, whose post office address is 7707 Forsyth Boulevard, St. Louis,
Missouri 63105 (hereinafter referred to as "Mortgagee"), in favor of COLLIER COUNTY, A POLITICAL
SUBDIVISION OF THE STATE OF FLORIDA, its successors and assigns, whose post office address is
3301 East Tamiami Trail, Naples, Florida 34112 (hereinafter referred to as "Collier County"). Mortgagee is
used as singular or plural, as the context requires.
WIT N E SSE T H:
WHEREAS, Mortgagee is the owner and holder of that certain Mortgage by and between The
Islands Hotel, LLC, a Florida limited liability company, Port of the Islands Investments, LLC, a Florida
limited liability company, Port of the Islands Properties, LLC, a Florida limited liability company, The
Islands Marina, LLC, a Florida limited liability company, and The Islands Club, LLC, a Florida limited
liability company, and First National Bank of St. Louis, dated December 14, 2005 and recorded on
December 16, 2005 at Official Records Book 394S, Page 4009, et seq.; and Assignment of Rents dated
December 14, 2005 and recorded on December 16, 2005 at Official Records Book 394S, Page 4024, et
seq.; and UCC Financing Statement recorded on December 16, 2005 in Official Records Book 394S,
Page 4037, et seq., all in the Public Records of Collier County, Florida (hereinafter collectively referred to
as "Mortgage"), encumbering the premises legally described therein (hereinafter referred to as the
"Encumbered Property");
WHEREAS, Collier County has requested and received from the fee simple owner of the
Encumbered Property a fee simple interest in portions of the Encumbered Property, which portions of the
Encumbered Property are legally described in Exhibit "A-1" and Exhibit "A-2" attached hereto and
incorporated herein by virtue of this reference (which premises are hereinafter referred to as the
"Parcels"); and
WHEREAS, Collier County has requested that Mortgagee release the Parcels from the lien of its
Mortgage, to which request Mortgagee has agreed.
NOW, THEREFORE, in consideration of TEN DOLLARS ($10.00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the Mortgagee does hereby
release and exonerate the Parcels from the lien and operation of its Mortgage; provided however, said
Mortgage shall remain in full force and effect except as to the released premises (the Parcels).
IN WITNESS WHEREOF, the Mortgagee has set its hand and seal the date and year first written
above.
