Access Easement - Folio #01067083700 Vc PROJECT: PORT OF THE ISLANDS MARINA FOLIO NO.: 01067083700 ACCESS EASEMENT THIS EASEMENT, made and entered into this I q11l day of December, 2008, by PORT OF THE ISLANDS PROPERTIES, LLC, a Florida limited liability company, whose mailing address is 2614 Tamiami Trail North, Suite 615, Naples, Florida 34103 (hereinafter referred to as "Grantor"), to COLLIER COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, its successors and assigns, whose mailing address is 3301 Tamiami Trail East, Naples, Florida 34112, (hereinafter referred to as "Grantee"). (Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument and their respective heirs, legal representatives, successors or assigns.) WITNESSETH Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a perpetual, non-exclusive easement for access purposes on, over, through and across the following described lands located in Collier County, Florida, to wi!: See attached Exhibit "A" which is incorporated herein by reference. Subject to easements, restrictions, and reservations of record. THIS IS NOT HOMESTEAD PROPERTY. TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter upon said land for all purposes of vehicular and pedestrian access and ingress, including use by the general public. The easement granted herein shall constitute easements running with the land and shall burden the lands described above. The Grantor, its successors or assigns shall retain the right (to the extent authorized by applicable laws and regulations) to: (i) use the easement area for any purpose which does not unreasonably interfere with the intended purpose of the easement granted hereby, including, without limitation, providing access to and from the Grantor's property, pathways, signage, utilities, lighting, drainage, water management, lot coverage calculations, setback areas, intensity calculations, open space, and landscaping for the benefit of the Grantor's property: and (ii) grant such additional easements thereover, provided that such additional easements do not unreasonably interfere with the intended purpose of the easement granted hereby.
