Subject to easements, restrictions, and reservations of record. (THIS IS NOT HOMESTEAD PROPERTY) TO HAVE AND TO HOLD the same unto the Grantee, together with the right to enter upon said land for all purposes of vehicular and pedestrian access, including use by the general public. Grantor and Grantee are used for singular or plural, as the context requires. The easement granted herein shall constitute easements running with the land and shall burden the lands described above. DATED: /2//'" lJe ITEM MOjO -IT *** OR: 4417 PG: 1534 *** EXHIBIT "Au LEGAL DESCRIPTION OF 184 FOOT WIDE ACCESS EASEMENT ACROSS A PORTION OF SECTION 9, TOWNSHIP 52 SOUTH, RANGE 28 EAST, OF COLLIER COUNTY, FLORIDA. Commence at the intersection of the East line of Section 9, Township 52 South, Range 28 East, of Collier County, Florida, and the South right-of-way line of U.S. 41 (Tamiami Trail). Run thence South 85049'13" West along said South right-of-way Iine1805.63 feet; thence 377.83 feet along the arc of a curve to the right having a radius of 2057.08 feet, a central angle of 10031'26", a chord of 377.30 feet and a chord bearing of North 88055'04" West to a point on the South right-of-way line of U.S. 41, said point also being the Point of Beginning of the following centerline description of a 184 foot wide access and utility easement (92 feet each side of centerline). Run thence South 00016'40" West 1426.73 feet to an intersection of a line extended Westerly from an existing seawall lying to the East of said centerline. Said intersection is the point of terminus of this access and utility easement.
