Round Table---Questions & Answers--BCC Direction (2:30-Adjourn) December 8, 2008 Chairman Henning called the Workshop to order at 1:00 PM and the Pledge of Allegiance was recited. Steven Tindale. Tindale-Oliver Assoc.; David Goldstein, Pasco County Assistant County Attorney; Robert Banks. Palm Beach County Assistant Attorney; Allan Ennis. Palm Beach County Assistant Director of Transportation were in attendance. Barbara Boy, Assistant Director. Broward County Planning Council was present via tele-conference. A document entitled "Transportation Fiscal Review" was submitted for review and a Power Point presentation was given. Nick Casalanguida, Director of Transportation Planning provided on overview of Item # l. 1. Fiscal Review (1 :00 - 1 :30) a. Revenue Streams i. Sources and Restrictions The Revenue Streams for Transportation include: . Impact Fees . Grants, Gas Tax . Ad Valorem Tax . MSTD (Municipal Special Taxing District). The Revenues are either restricted or unrestricted in their usage. The Revenue Estimated for 2008-2013: . Impact Fees - $25 - 35M . Gas Tax - $18M - $24M . General Fund (MSTD - AD Valorem) $24M . General Fund/MSTD General Fund Transfer Supporting Operations - $17.5M . Grants $2M - 8M . Commercial Paper - $50M (As Needed) b. Expenditures i. Cost of Ownership Roadway improvement projects near completion or which have been recently completed have provided "on-going maintenance" to the roadway areas due to the ongoing capital expenditures. Upon completion, the projects will be subject to long-term public maintenance. He recommended future Executive Summaries and budgets for Capital Projects account for the on-going maintenance and cost of ownership of the proj ect. 2 December 8, 2008 c. Cost Reduction Strategies i. In-house Construction Engineering Inspection Outsourcing of engineering consulting has been reduced due to the existing economic climate. ii. Value Engineering More value engineering will be utilized in the future which assists in reducing design and construction costs. iii. Mitigation & Permitting Continued utilization of mitigation opportunities available on County properties (Panther Habitat Units from Conservation Collier's Pepper Ranch property) will be employed. d. Planning Initiatives i. pPP's ii. County Build-Out Vision Plan (RLSA) 1. Land Use 2. Multi - Modal Priorities Begin to develop a County build-out Plan to create a Master Plan to assist Transportation Planning in the location of County facilities (landfills, Government Services, Transit Facilities, etc.) which will provide a more cost effective road network. iii. Corridor Management Develop a Corridor Management Plan to facilitate the acquisition of property for roadway improvements. 2. Corridor Management (1 :30 - 2:30) a. Introduction to Corridor Management (Tin dale-Oliver) (1 :30 - 1:45) Best Practices/Biggest Challenges Steve Tindale of Tindale-Oliver Assoc. provided and overview on the concept of Corridor Management noting the following: . It identifies transportation corridors and attempts to manage them before they become improved. . Right-of-way vs. Corridor - Right-of-way - owned and rigid; Corridors - managed and provides more flexibility. . The concept of a Plan is incorporated in Policy 3.5 of the Growth Management Plan (GMP). . The Plan will be implemented through requirements in the (LDC) Land Development Code (required setbacks, structure locations, etc.) . It provides for advance notice to current and future landowners, orderly development and fewer development impacts. . Critical Intersections are also identified in the Management Plan. 3 December 8, 2008 . The Plan will allow for interim land uses and incorporate a waiver process for uses within the Corridor (landscaping, recreation, etc.) b. Broward County (Barbara Boy via phone) 10 Min. Barbara Boy, Assistant Director, Broward County Planning Council noted the following: . A Management Plan has been in place since the 1960's. . The Program has been highly successful in Managing Transportation issues. . It has provided a large tax savings by acquiring some right-of- ways at no cost to the County. . It can be difficult to implement the Plan in existing developed areas or infill areas. c. Palm Beach County (Allan Ennis & Robert Banks) 10 Min. Allan Ennis, Palm Beach County Assistant Director of Transportation noted the following: . Thoroughfare Plan has been in place since 1976. . It did face legal challenges which were overcome throughout the process. . The Plan utilizes base building lines which protects areas from permanent structures but allows temporary structures such as signs, fences, etc. to be removed at the time of road construction. . The municipality jurisdictions within the County are not subject to the requirements of the Plan; separate negotiations are. d. Pasco County (David Goldstein) 10 Min. David Goldstein, Pasco County Assistant County Attorney noted the following: . The County has a more recently implemented Plan (2005) . It assists in reducing the impact fees for right-of-way. . The strategies utilized are Administrative Variances, Transfers of Density, and Allowance ofInterim Uses, etc. . Pasco County is more undeveloped so fewer urban challenges are encountered in developing and implementing the Plan. e. Corridor Management Question and Answer 15 Min. The following points were noted: . There is a difference between exactions ofright-of-way and management. . Some of the Counties actually use exactions (acquisition of right of way) in the process as opposed to land use management. . In management, the landowner retains the property, its density and allowable uses. 4 December 8, 2008 . The land area in question remains taxable until the property is acquired. . The variance procedure allows flexibility for landowners who face a hardship in reasonable utilization of the property. . The exaction process generally occurs at the Site Plan Development stage. . The density preservation of properties within the Corridor applies to commercial and residential properties. . Improved lots would be grandfathered (additions, remodeling, etc. allowed) 3. Round Table - Questions & Answers - BCC Direction (2:30 - Adjournment) The Board recognized future Executive Summaries and budgets for a Capital Project will account for the annual maintenance and cost of ownership of the project. Discussion ensued on the logistics of implementing the Plan and whether the GMP information required may be minimized to facilitate the future amendment process. The general opinion of the participants were changes in roadway designs, etc. that may occur within the Corridor identified and approved in the GMP, however items such as revision in the widths of the Corridor would require an amendment to the GMP. It was noted some of the roads slated for future improvement are incorporated into the existing Long Range Transportation Plan; however the Corridor Management Plan will assist in providing notice to landowners on future Transportation improvements so they may make informed decisions on land use. It was recommended, to provide legal notice of the Plan to affected individuals at the time of property purchase (constructive notices, disclosure statements for buyers, etc.), as opposed to individuals being notified at the land development stage. It was noted this process should be legally researched for constitutionality. Discussion ensued on the impact fee rates in relation to declining costs of property values in the current market and when impact fees will decrease as a result of this factor.
