Resolution 1993-040 FrnRllARY 2, 1993 RESOLUTION NO. 93- 40 A :RZSOLlllIOtl COtlFIRMltlG THE BOARD'S INTEtlT THAT THOSE BOARD KEKBERS SERVING ON THE VARIOUS ADVISORY BOARDS AND COMMISSIONS AIID QUASI-JUDICIAL BOARDS OF THE COUNTY WHDI SAID BOARDS AIID COKMISSIONS WHERE INCORPORATED INTO THE LAND DEVELOPMENT CODE, AND IN SOME INSTANCES LATER REMOVED FROM THE LAllD DEVELOPMEllT CODE, WERE TO BE COtlSIDERED CONTltlUING MEMBERS OF SAID BOARDS AND COMMISSIONS AIID WERE COtlTINUOUSLY THE DESIGNATED MEMBERS OF SAID BOARDS OF COKMISSIONS. WHEREAS, the Board of County Commissioners adopted the Unitora Land Development Code, Collier County Ordinance No. 91-102, as amended, for the purpose of consolidating the County's land development regulations, approval processes and required by statute and efticiency and convenience purposes; and WHEREAS, in order to accomplish this purpose, various ;:,*:.'ordinanc8S relating to County advisory and quasi-judicial boards ".t' ~~.:'var. repealed and re-enacted as part of Collier County Ordinance i." ~~'KO. 91-102, as amended; and '~-" it was Wl!E:REAS , ;,~. <; ! >~, '}that the 4~i.'~ ".ub8equent ,;~';< the Board of County Commissioners' intent action of repealing ordinances Buch any and their re-enactment as part of Collier County Ordinance No. 91-102, as amended, was not to disrupt or interrupt the or the service provided board or commission members; and WHEREAS, the Board of County Commissioners intended that those Ilembers of boards and commissions serving pursuant to an ordinance repealed and Bubsequently re-enacted in Collier County Ordinance No. 91-102, as amended, continue to serve on their respective boards or commissions in a continuous Ind uninterrupted ~nner and were to serve out their remaining terms; and WHEREAS, the boards or commissions consolidated in the Land Development Code were the Code Enforcement Board, Contractors ~-i"":;-~_ . Licensing Board, Collier County Planning Commission, Environmental .!l;, . i\/',Adviaory Board, Building Board of Adjustment and Appeals and the :~> ~ 3; Hiatoric/Archaeological Preservation Board; and :~'i"; ,'J(~? WHEREAS, the placement of the Code Enforcement Board and the . ~1 ' ,;: Contractors Licensing Board regulations into Collier County 100! ODO "Gl 3G FrnRllARY 2, 1993 Ordinance No. 91-102, as amended, was later determined to be unnec...ary and unwieldy, therefore, said boards were removed from Collier County Ordinance No. 91-102, as amended, and such boards continued in substantially the same form through Collier County Ordinance No. 92-80, and Collier County Ordinance No. 90-105, as aaended. It was the Board of County Commissioners' intent that tho.. .embers serving on said boards at the time of the boards' r81loval tram Collier County Ordinance No. 91-102, as amended, continue to serve without interruption and such members were at all times the designated and appointed members of ~aid boards. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMKISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. It vas the Board of County Commissioners' intent that the repeal of Ordinance Nos. 88-89, as amendedj 90-105, as ~ended; 91-68, as amendedi 85-51, as amendedi 83-16, as amendedi and 91-70, and subsequent re-enactment of said Ordinances in Collier County Ordinance No. 91-102, as amended, was for the purpose of consolidating the County's land regulation process into one ordinance as required by state statute and for the purposes of efficiency and convenience. 2. It was and is the Board of County Commissioners' intent that there would be no interruption in the functionality or operation of said repealed and later re-enacted ordinances or the board. or commissions provided for thereunder or in the service or appointment ot any board member or commission member serving on any county board. 3. The members serving on the various boards or commissions created pursuant to the above-referenced ordinances were and are intended to continue their service on those boards or commissions at all times and are the designated members of those boards or comaisslons until their term. otherwise expired or expires. The repeal and SUbsequent re-enactment of any advisory board or commiss"lon or quasi-judicial board ordinance is not intended to attact and shall not affect the members appointment to such board or. cOllmission. 'i~novich ~:Aa.l.tant County Attorney FrnRllARY 2, 1993 removal of the Code Enforcement Board and Licensing Board from the provisions of the Land Code ~nd subsequent re-enactment of said ordinances by Collier County Ordinance Nos. 92-80 and 90-105, as amended, respectively, was intended to occur without affecting the functionality or operation of said boards. The members serving on said boards at the time of the deletion of the ordinances from COllier County Ordinance No. 91-102, as amended, and subsequent re-enactment were and are intended to continue to serve on said boards and are the designated membp.rs of said boards until their tara otherwise expired or expires and until they are reappointed or a new member is appointed to serve on such board to fill any vacancy. 5. The appointment ot all such advisory board or commission and/or quasi-judicial board members as described herein is hereby astablished, re-established, ratified and confirmed. 6. This Resolution is intended to and shall supersede any previous resolution relating to members appointed to advisory or quasi-judicial boards or commissions to the extent of any conflict herewith. Any reference to or citation to an authorizing, establishing or subject advisory board or quasi-judicial board regulation or ordinance, ~hich has been set forth in a resolution appointing a member or establishing their term, is hereby amended to reterence and cite the applicable advisory board or commission or quasi-judicial board ordinance currently in effect.
