Resolution 1994-348 RESOLUTION NO. 94-~8 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA DETERMINING THAT REVISIONS TO THE PINE AIR LAKES DEVELOPMENT ORDER 85-5 DO NOT CONSTITUTE A SUBSTANTIAL DEVIATION REQUIRING FURTHER DEVELOPMENT OF REGIONAL IMPACT REVIEW. WHEREAS, the Board ot County Commissioners of Collier County, Florida approved Development Order 85-5, as amended, (the Development Order) on November 12, 1985 which approved a Development ot Regional Impact (DRI) known as pine Air Lakes; and WHEREAS, Section 380.06(19)(f)2, Florida Statutes. requires that proposed changes to a previously approved Development of Regional Impact (DRI) be submitted by the developer to the local government, the regional planning council and the state land planning agency; and WHEREAS, submittal ot the proposed changes was made to the appropriate public authorities; and WHEREAS, section 380.06(19) (t)5, Florida Statutes, requires that the local government shall determine whether or not the proposed change to the previously approved DRI development order constitutes a substantial deviation requiring turther Development-of-Regional-Impact review; and WHEREAS, the Board ot County Commissioners of Collier County has reviewed and considered the report and recommendations ot the Southwest Florida Regional Planning Council (SWFRPC) and held a public hearing on Mav 10, 1994 on the petition; and WHEREAS, by separate action the Board ot county commissioners will cause pine Air Lakes Development Order to be amended to retlect the proposed revisions which do not constitute a substantial deviation requiring further Development-ot-Regional-Impa~t review; . aOOK uOO PAC., 169 ----_......-~,~~~ '",,'" ~,,~ ._'m~,___N'_<'" ^-_.,-~.__...~-"- MAY 10, 1;;4 NOW, THEREFORE, be it resolved by the Board ot County Commissioners ot Collier County, Florida that: The proposed revisions to pine Air Lakes Development Order 85-5, as described in Petition DOA-94-l, noted as Exhibit "A" and hereto made a part ot this Resolution do not constitute a substantial deviation requiring further Development ot Regional Impact review.
