Resolution 1995-328 RESOLUTION NO. 95-~ 8 2 11 A RESOLUTION AUTHORIZING THE ACQUISITION OF NON-EXCLUSIVE, PERPETUAL SIDEWALK, LIGHTING AND LANDSCAPING EASEMENTS, SLOPE EASEMENTS AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE CONSTRUCTION OF THE ROADWAY CORRIDCR IMPROVEMENTS FOR VANDERBILT BEACH ROAD (FROM U.S. 41 TO AIRPORT-PULLING ROAD), CIE PROJECT NO. 023. WHEREAS, the Board of County Commissioners, on September 27, 1994 adopted Ordinance No. 94-54 therein establishing the 1994 (Sixth Annual) Capital Improvement Element of the Growth Management Plan in order to establish priorities for the design, acquisition and construction of the various capital imp~ovement projects which comprise the Transportation Element of the County's Comprehensive Plan: and WHEREAS, the corridor roadway improvements for Vanderbilt Beach Road from u.s. 41 to Airport-Pulling Road are component parts of the Transportation Element of the County's Comprehensive Plan; and WHEREAS, the Board of County Commissioners on November 1, 1994, adopted Resolution No. 94-761 authorizing the County Staff to acquire by gift or purchase certain easements and fee simple title to the property and property interests required and necessary for the corridor roadway improvements of Vanderbilt Beach Road from U.S. 41 to Airport- Pulling Road; and WHEREAS, the County Staff has evaluated alternative locations, reviewed the environmental factors, considered the cost variables, and analyzed the safety and welfare considerations as they relate to the construction of the corridor roadway improvements for Vanderbilt Beach Road from U.S. 41 to Airport-Pulling Road; and WHEREAS, the County Staff has recommended that it is necessary and in the best interest of Collier County, Florida, to acquire certbln non-exclusive, perpetual sidewalk, lighting and landscape easements, slope easements and temporary construction easements which are required and necessary for the construction of the corridor roadway improvements for Vanderbilt Beach Roati from U.S. 41 to Airport-pulling Road~ and -Page 1- 8 2 U Ii WHEREAS, the construction of the corridor roadway improvements for Vanderbilt Beach Road from u.s. 41 to Airport-Pulling Road is necessary in order to protect the health, safety and welfare of the citizens of Collier County and is in the best interest of Collier County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- SIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board that th€ construction of the corridor roadway improvements for Vanderbilt Beach Road from U.S. 41 to Airport-Pulling Road (hereinafter referred to as "the project") is necessary for a public purpose and is in the best interests of Collier County. AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff analysis regarding alternative locations, environmental factors, cost variables, safety and welfare considerations as they relate to the construction of the Project and finds that the most feasible locations for the certain non-exclusive, perpetual sidewalk, lighting and landscaping easements, slope easements and temporary construction easements are described in Exhibit nAil attached hereto. AND IT IS FURTHER RESOLVED that the construction of the project is part of the County's long range plan that is included in the Trans- portation Element of the County's Comprehensive Plan. AND IT IS FURTHER RESOLVED that to implement said construction of the Project it is appropriate and necessary for the Board to acquire a certain non-exclusive, perpetual sidewalk, lighting and landscape easements, slope easements and temporary construction easements described in the attached Exhibit "A", attached hereto and incorporated herein, which are necessary for the construction of the corridor roadway improvements for ~he Vanderbilt Beach Road from u.S. 41 to Airport-Pulling Road. -Page 2- 8 H 2 AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acquire by gift, purchase or condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida statutes, the certain non-exclusive, perpetual sidewalk, lighting and landscape easements, slope easements and temporary construction e-3.sements being more particularly described in Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that no mobile homes are located on the property sought to be acquired and therefore it will not be necessary to remove any mobile homes from the property to be acquired.
