RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA
REGARDING SPECIAL NOTATION CONCERNING
GOPHER TORTOISE MANAGEMENT PLAN DATED
JANUARY 19, 1992 ON PLAT OF SOUTH HAMPTON ,
UNIT ONE, RECORDED IN PLAT BOOK 19, PAGE
921 OF THE PUBLIC RECORDS OF COLLIER COUNTY
WHEREAS, the plat of Southhampton, Uni t One was recorded in
Plat Book 19, Page 92, of the public records of Collier County;
WHEREAS, said plat contained a special notation concerning
preservation areas pursuant to a gopher tortoise management plan
to be conveyed to the County by easement in the future;
WHEREAS, the gopher tortoise management plan submitted to the
Florida Game and Freshwater Fish Commission has been amended, and
a notice of taking was issued dated January 26, 1995;
WHEREAS, in lieu of the areas identified on t:he plat, the
Owner has proposed the conveyance of an alternative preservation
area by easement, a copy of which is attached and will be recorded
in the public records of Collier County; and
WHEREAS, the Environmental Department of Development Services
has reviewed the modified plan and confirmed that the alternative
preservation area is consistent with the Collier County Land
Development Code; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS that:
1. Only eleven (11) acres of gopher tortoise preserve area
shall be set aside pursuant to the amended management plan
approved by the Florida Game and Freshwater FiSh Commission;
2. The attached preservation easements are hereby accepted
in lieu of the gopher tortoise preserve easements contained in
special notation on the plat.
3. The Collier County Clerk of Courts is directed to make a
notation on the plat of Southhampton, Unit One concerning this
Resolution.
