Resolution 1995-151 10 Cr'Jrl RESOLUTION NO. 95-~ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, URGING THE U. S. CONGRESS TO REVISIT THE NATIONAL VOTER REGISTRATION ACT AND PROVIDE THE NECESSARY FUNDING FOR IMPLEMENTATION OF THE ACT. WHEREAS, in 1994 the united States Congress adopted the National Voter Registration Act (NVRA), a/k/a the "Motor-Voter Act," effective as a Federal law on January 1, 1995; and WHEREAS, the NVRA requires the states to register voters at various Departments of Motor Vehicles, public aid agencies, other pUblic offices, and by U.S. mail; and WHEREAS, the NVRA allows for voting by persons who have moved without having changed their registration address. The NVRA also limits purging voter registration rolls and prohibits states from removing voter registrants from the rolls for non-voting; and WHEREAS, the ability of persons to register simUltaneously to vote in multiple jurisdictions due to inappropriate safeguards regarding the forfeiture of currently held drivers licenses is of grave concern to this Board and should be of grave concern to the U. S. Legislature; and WHEREAS, the ability of persons to register to vote without clear and sufficient evidence of U.S. citizenship is of grave concern to this Board and should be of grave concern to the U.S. Legislature; and WHEREAS, the NVRA is an unfunded federal mandate imposed upon and shared by state and local governments; and WHEREAS, there has been introduced in the current United States Congress, H.R. 370, a bill to repeal the National Voter Registration Act (NVRA); and WHEREAS, there has been introduced in the United States Senate, S.91, a bill that would delay implementation of the National Voter Registration Act (NVRA) in the states until the Congress appropriates funds to pay the state and local governmental expenses of implementing the NVRA; and WHEREAS, the Board of County Commissioners of Collier 1 . 10 C County, Florida, having knowledge of the National Voter Regis- tration Act and being apprised of state and local implementation issues, problems and funding short-falls, has determined that the Board's position on this matter should be communicated to Florida's U.S. Senators and Congressmen. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1) The Board of County Commissioners of Collier County, Florida, urges the U. S. Congress to revisit the National Voter Registration Act (NVRA) and provide the necessary funding for implementing the act. 2) The Board of County Commissioners of Collier County further urges the U.S. Congress to review and legislatively address the lack of appropriate safeguards to prevent (1) the simultaneous registration of voters in multiple jurisdictions and (2) the ability of persons to register to vote without clear and sufficient evidence of U.S. citizenship. 3) The Clerk to the Board is instructed to spread this Resolution in the minutes of the Board, and 4) A certified copy of this Resolution be sent to each of the State of Florida's United States Senators and Congressmen.
