Resolution 1995-139 RESOLUTION NO. 95- 139 12C 1 RELATING TO PETITION NUMBER ST-94 -4 FOR SPECIAL TREATMENT DEVELOPMENT TO ALLOW CONSTRUCTION OF A PARKING LOT AT THE SOUTH TERMINUS OF THE BAREFOOT BEACH PRESERVE (COLLIER COUNTY PARK) PROPERTY WITH A SPECIAL TREATMENT CST) OVERLAY HEREINAFTER DESCRIBED IN COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the state of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public health, safety and welfare; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) , as amended which establishes regulations for the zoning of particular geographic divisions of the County; and WHEREAS, the Board of County Commissioners, being the duly elected constituted board of the area hereby affected, has held a pUblic hearing after notice as in said regulations made and provided, and has considered the advisability of allowing the construction of a gravel surfaced parking lot at the south terminus of the Barefoot Beach Preserve (Collier County Park) property as shown on the attached plot plan, Exhibit "A", in a (CON/ST) Conservation/Special Treatment zoning district for the property hereinafter described, and has found as a matter of fact that satiSfactory provision and arrangement has been made concerning all applicable matters required by said regulations and in accordance with section 2.2.24 of the Land Development Code for the incorporated area of Collier County; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled and the Board having considered all matters presented. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS of Collier County, Florida, that Petition ST-94-4 filed by Robert C. Wiley, P.E., Office of Capital Projects Management, representing Collier County Board of County Commissioners, with respect to the property more particularly described as: -1- 12C 1 The north 500 feet of section 17, Township 48 South, Range 25 East, Collier County, Florida; lying west of Little Hickory Bay and lying east of the Mean High Water Line of the Gulf of Mexico; together with: The south 100 feet of Section 8, Township 48 South, Range 25 East, Collier County, Florida; lying west of Little Hickory Bay and lying east of the Mean High Water Line of the Gulf of Mexico. be approved for a Special Treatment Development Permit allowing the construction of a gravel surfaced parking lot at the south terminus of the Barefoot Beach Preserve (Collier county Park) property as shown on the attached plot plan, Exhibit "A" of (CON/ST) Conservation/Special Treatment zoning district said property is located, sUbject to the following conditions: See EXHIBIT liB" attached hereto and made a part hereof. BE IT RESOLVED that this Resolution relating to Petition Number ST-94-4 be recorded in the minutes of this Board. This Resolution adopted after motion, second and majority vote favoring same. Wiley, as owner or authorized agent for Petition ST-94-4, agree to the following stipulations requested by the Collier County Planning Commission in their public hearing on, January 19th, 1995. 1. Prior to final site Development Plan approval the petitioner shall obtain all necessary state and federal permits as they pertain to the protected species on-site. 2. All native vegetation within the limits of clearing that can be transplanted (into areas devoid of vegetation or into other areas of the Park as enhancement to the existing vegetation) shall be relocated prior to the beginning of any construction in that area. 3. Submit a management plan pursuant to Collier County Land Development Code Section 3.9.5.3 prior to final SDP approval.
