RESOLUTION FOR PETITIOn TIV 93-016 TO VACATE A
30 FOOT ACCESS EASEMENT OF EAGLE ACRES AS
DESCRIBED ON THE PLAT OF EAGLE ACRES RECORDED
IN PLAT BOOK 4, PAGE 15, Or. THE pUBLIC
RECORDS OF COLLIER COUNTY, FLORIDA.
WHEREAS, pursuant to section 177.101, 336.09 and 336:10
F.S., R. Scott Price as agent for owner, East Sound Realty, Inc.,
doe. hereby request the vacation of a 30 foot access easement
deacribec1 on the plat of Eagle Acres recorded in Plat Bool< 4.
Page 15, of the Public Records of Collier County, Florida; and
WHEREAS, the Board has this day held a public hearing to
consider vacating a portion of said plat as more fully described
below, and notice of said public hearing to vacate was given as
required by law: and
WHEREAS, the granting of the vacation will not adversely
affect the ownership or right of convenient access of other
property owners.
WHEREAS, the vacation and abandonment of the 30 foot access
e.s_nt located on a portion of the plat of Eagle Acres as
recorded in Plat Book 4, Page 15, of the Public Records of
Collier County, Florida, would benefit the general public welfare
and is in the bast interest of the public in the following
particulan:
1. The replacement 20 foot lake maintenance easement.
2. The grant of a 30 foot by 75 Coot drainage easement
connecting the drainage easements shown on the plat of Sunset
Ho.es to the lake on the plat of Ilarrington Sound.
NOW, THEREFORE, BE IT RESOLVED BY TIlE BOARD OF COUNTY
COKKISSIONERS OF COLLIER COUNTY, FLORIDA, that the following be
and i. hereby vacated:
See Exhibit "A" attached to and incorporated herein.
BE IT FURTHER RESOLVED, that the Clerk i. directed to
advertise the adoption of this Resolution once in a paper of
general circulation in the County within 30 days following its
adoption.
