Po .: B . 2'" RESOLUTlOl'i r..o. 97-.W- A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND BY GIFT, PURCHASE OR CONDEMt';A TION OF NON-EXCLUSIVE, PERPETUAL ROAD RIGHT-OF-WAY, SIDEWAl.K, UTILITY, DRAINAGE, MAINTENANCE AND TEMPORARY CONSTRUCTION INTERESTS BY EASEMENT FOR THE CONSTRUCTION OF THE SlX-LANING ROADWAY IMPROVEr\IENTS FOR AIRPORT-PULLING ROAD (C.R. 31) PROJECT FROM PINE RIDGE ROAD (CR. 896) TO V ANDERBILT BEACH ROAD (C.R. ?'62). WHEREAS, the Board of County Comrnission<.:r:;, on Scptember 27, 199'+. adopted Ordinance No. 94-54 therein establishing the 1994 (Sixth Annual) Capital1mprovcl11cnt Element of the Growth Management Plan in order to establish priOrities for thc design, acquisition and constructiun ofthc various capital improvement project:. which comprise the Transportation E!ement of the County's Comprehensive Plan; and WHEREAS, the six-Ianing improvements to Airport-Pulling Road fiOl11 Pine Ridge Road to Vanderbilt Beach Road arc component parts of thc Transportation Element of the County's Comprehensive Plan; and WHEREAS, the Board of County Commissioners, on April 8, 1997. adopted Resolution No. 97,19R a.jthorizing the County Staff:o acquire by gift or purchase certain easements or fee simple title to the property and property interests rel.]uired and necessary for the six-lai'ling roadway improvements of Airport-Pu\1ing Road hom Pine Ridge Road to Vanderbilt Beach Road; and NOW, THEREFORE, BE IT RESOLVED !W THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been delcnnincd by the Board thatl.he construction of the six-Ianing roadway improvemt:l1ts for Airport-Pu\1ing Read from Pine Ridge Road to Vanderbilt Beach Road, (hereinafter relerred to as "the Project") is necessary and in the public's best interest in order to prOtl.:ct thp. health, sai'cty and welfare of the citizens of Collier County. AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff analysis regarding alternative locations, environmelltal factors, cost variable-s, safet)' and welfare COilsiderations as lh~y rclalt: to the con8truction of the Project and finds that the most feasible location for the road right-of-way for the certain non-exclusive, papetual road right-of-way, sidewalk, utility, drainage, maintenance and temporary construction interests by e~sement are described in Exhibit "A" attached hereto and incorporated herein A.l\iD IT IS FURTHER RESOLVED that the construction of the Project i~ part cfthe Count)'s long range plalllhat i~ included in the Transportation Element of the County's Comprehensive Plan; f'age 1 .J 8 8 2~ AND IT IS FURTHER RESOLVED that to implement constrUction of the Project it is approp,riate and necessary for lhe Board to acquire certain non-exclusive perpetual road right-of-way, sidewalk, utility, drainage. maintenance and temporary construction interests by easement described in the attached Exhibit .. A", attached hereto and incoflX'lrated herein, which are necessary for the const.-uction of the six-Ianing roadway improvements for Airport-Pulling Road (C.R. 31) from Pine Ridge Road (C.R. 896) to Vanderbilt Beach Road (C.R, 862). AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acqui~e by gift, purchase or condemnation in accordance with the provisions of Chaplers 73,74 and 127, Florida Statutes, lhe certain non-exclusive, perpetual road right-of,way, sidewalk, utility, drainage, maintcn.1l'lce and temporary construction interests by easemenl being more particularly described in Exhibit' A", attach~ hereto a.nd incorporated herein. AND IT IS FURTtlER RESOL VED that no m(lbile homes are located on the property sought to Ix acquired and therefore it will not be necessary to remove any mobile homes from tht: property to be acquired.
