A RESOLUTION bY THE BOARD OP COUNTY
COMMISSIONERS OP COLLIER COUNTY,
FLORIDA, PURSUA.Yf TO SECTION 2.7.3.4
OF THE COLLIeR COUNTY LAND
DEV2LOPMENT CODE AFFECTING ORDINANCE
89-62 ALSO N~Oh~ AS SHOPPES AT SANTA
BARBARA PUD, REQUIRING THE SUBMITTAL
OF A PUD AMENDMENT; AND PROVIDING fu~
EFFECTIVE DATE.
WHEREAS, the Shoppes at Santa Barbara PUD, Ordinance 89-62
adopted on Septenlber 12 , 1989, is slJbject to the provisions of
Section 2.7.3.4., ot the Land Development Code (LDC) , Time Limits
for Approved PUD Master Plans; and
WHEREAS, the Board of County Commissioners has reviewed the
PUD and has determined that the current. PUD Zoning is
inconsistent with ce~tain provisions of the Growth Management
Plan (GMP) and the Land Development Code; and
NOW, THEREFORE BE IT RESOLVED, by the Board of Zoning
Appeals of Collier County, Florida t.hat:
1. The above recitals are adopted herein by reference
as if fully set forth herein.
2. This Resolution sh~ll constitute evidence of
compliance with the review requirements of Section
2.7.3.4 of the LOC.
3. Pursuant to said section of the LOC, the property
owner or agent shall submit an amended PUD to the
Planning Services Director prior to November 20,
1997 in order to calIse said PUD to become
COflsistent with the Collier County LDC.
This Resolution shall b~co;ne effective immediately upon its
approval.
BE IT FURTHER RESOLVED that this Resolution be recorded in
the minutes of this Board and i~ the records of the Petition for
which the extension is granted.
