Resolution 1996-593 RESOLUTION NO. 96--22} A RESOLUTION OF THB BOARD OF COUNTY COKKISSIONERS OF COLLIER COUNTY. FLORIDA. SETTING PORTH ITS INT~ TO USB THB UNIPORM KETHOD OF COLLECTING NON-AD VALOREX ASSESSMENTS POR INTERIM GOVERKHENTAL SERVICE FEES WITHIN THE UNINCORPORATED AREA AND THB INCORPORATED AREAS OF COLLIER COUNTY. WHEPEAS, the Board of County Commissioners of Collier County, Florida, (hereinafter referred to as Board or County) has determined that certain costs of government services provided to identified parcels of real property should be paid for through the development and imposition of interim governmental service fees imposed uJ)on such parcels; and WHER1~S, the Board has determined that a non-ad valorem assessmenl: is the most feasible method to impose to collect interim governmental service fees against properties within the unincorporated and incorporated areas of Collier County; and WHEREAS, the Board has identified and recognizes a need for the levy of a non-ad valorem assessment for the interim government;>l service fees and elects to use the uniform method of collecting such assessments; and WHER~\S, Section 197.3632, Florida Statutes, provides for the uniform met.hod of collecting non-ad valorem assessments and said Section requires that the County adopt a resolution at a public hearing prior to January 1 stating its intent to use the uniform method of collecting non-ad valorem assessments; and WHEREA,S, Section 197.3632, Florida Statutes, also requires that the C01lnty publish notice of its intent to use the uniform method of collecting non-ad valorem assessments weekly in a newspaper of general circulation within each county contained in the County for four consecutive weeks prior to the hearing; and WHEREAS, the County has published the required notices. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. There is a need for the levy of a non-ad valorem assessmen1: to provide for the imposition and collection of interim governmen1:al service fees. 2. The non-ad valorem assessments levied for the Interim Governmen1:al Service Fees against the properties located within the unincc)rporated area and incorporated areas of Collier County, Florida, t:hat receive a Certificate of Occupancy between September 1, and th€! following August 30 of each year that are not shown as an improvmnent ta the real property on the ad valorem tax bill may be collect:ed utilizing the uniform method for collecting such non-ad val.orem assessments as provided in Section 197.3632, Florida St:atutes. The special assessment to be levied as the non-ad vaJ.orem assessment shall pay for the enhanced County services ~Irovided by the County by virtue of the existence of the said imprclvement(s) on the real property and the use, occupancy or potential use or occupancy of the improved property. The special assessment is for the interim governmental service fees that are imposed on the improved real property being given a certificate of occupancy for the portion of a tax year rem3ining subsequent to the issuance by the County of the certificate of occupancy. 3. The County recognizes the requirement of Section 125.01(1) (q), Florida Statutes, that provides that the boundaries of a municipal service benefit unit may include all or part of the boundaries, of a municipality (in addition to all or part of the unincorporated area) subject to the consent by ordinance of the governing body of the affected municipality given either annually or for a t.erm of years. It is the County's intent to use the uniform mE:thod of collecting non-ad valorem assessments for interim gc,vernrnental service fees for the unincorporated area of Collier County and for any municipality within Collier County that consents pursuant to Section 125.01(1) (q), Florida Statutes. If the governing body of a municipality does not adopt a consent ordinance referenced in Section 125.01(1) (q), Florida Statutes, by 2 12C-8' February I, 1997, then such municipality shall not be included within the interim governmental service fees municipal service benefit unit. If no municipality consents through its governing body for all or a part of its municipal boundaries to be included in such tlenefit unit, the County intends to use the uniform method of collec:ting non-ad valorem assessments for interim governmental service f"ees for the unincorporated area of Collier County. 4. A legal description of the boundaries of the re~l property subject to the levy is provided in the document entitled "COLLIER COUNTY" and Exhibits "A" and "811 attached hereto and made a part hereof. 5. A copy of this Resolution shall be mailed by United States mail to the Collier County Property Appraiser, the Collier County Tax Collector, and the state of Florida Department of Revenue by January 10, 1997. 6. This non-ad valorem assessment is a one time assessment upon improved real property for interim governmental service fees.
