Resolution 1996-576 12C 2 RESOLUTION NO. '6--212 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, SETTING FORTH ITS INTENT TO USB THB UNIFORM METHOD OF COLLECTING NON-AD VALOREK ASSESSMENTS FOR BEAUTIFICATION OF RECREATIONAL FACILITIES AND MEDIAN AREAS, AND MAINTENANCB OF CONSERVATION OR PRESERVB AREAS, U.S. 41 BERKS, STREET SIGNAGB REPLACEKENTS WITHIN THE MEDIAN AREAS AND LANDSCAPING IHPROVEKENTS TO U.S. 41 ENTRANCES, ALL WITHIN THB PELICAN BAY HOHICIPAL SERVICE TAXING AND BENEFIT UNIT. WHEREAS, the Board of County Commissioners of Collier County, Florida, (hereinafter referred to as COUNTY) established the Pelican Bay Municipal Services Taxinq and Benefit Unit for the purpose of providing water management operations and maintenance, beautification of recreational facilities and median areas, and maintenance of conservation or preserve areas, U.S. 41 berms, street signage replacements within the median areas and landscaping improvements to U.S. 41 entrances; and WHEREAS, the COUNTY intends to finance water management operations and maintenance, beautification of recreational facilities and median areas, maintenance of conservation or preserve areas, u.s. 41 berms, street signage replacements within the median areas and landscaping improvements to u.s. 41 entrances through the levy of a special assessment (non-ad valorem assessment) to those properties benefited by the project. Said properties are located within the boundaries of the Pelican Bay Municipal Services Taxinq and Benefit Unit which are described herein; and WHEREAS, Section 197.3632, Florida Statutes, provides a uniform method of collectinq such assessments and said Section requires that the COUNTY adopt a resolution at a public hearing prior to January 1 stating its intent to use the uniform method of collecting such non-ad valorem assessments; and WHEREAS, Section 197.3632, Florida Statutes, also requires that the COUNTY publish notice of its intent to use the uniform method ot collecting such non-ad valorem assessments weekly in a 1 12C 2 newspaper ot general circulation within each county contained in the boundaries at the Pelican Bay Municipal Taxinq and Benefit Unit tor tour consecutive weeks prior to the hearing; and WHEREAS, the COUNTY has published the required notices. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The non-ad valorem assessments levied tor water management operations and maintenance, beautification of recreational facilities and median areas, and maintenance ot conservation or preserve areas, U.s. 41 berms, street signage replacements within the median areas and landscapinq improvements to U.S. 41 entrances for the property located within the Pelican Bay Municipal Services Taxing and Benefit Unit described as: A tract of land beinq in portions of Sections 32 and 33, Township 48 South, Range 25 East; together with portions of Sections 4, 5, 8 and 9, Township 49 South, Range 2S East, Collier County, Florida, being one and the same as the lands encompassed by the Pelican Bay Improvement District, the perimeter boundary of same more particularly described as follows: Commencing at the Southeast corner of said Section 33; thence South 89 degrees 59 minutes 50 seconds West alonq the South line of Section 33 a distance of 150.02 feet to a point on the West riqht-of-way line of U.S. 41 (State Road 45), said point also beinq the Point of Beqinninq; thence Southerly alonq the West riqht-of-way line of said U. S. 41 (State Road 45) the tOllowinq courses: South 00 degrees 58 minutes 36 seconds East a distance of 2.49 feet; thence South 00 deqrees 55 minutes 41 seconds East a distance of 3218.29 feet; thence South 01 degrees 00 minutes 29 seconds East a distance of 3218.56 feet; thence South 00 degrees 59 minutes 03 seconds East a distance of 2626.21 teet; thence South 01 degrees 00 minutes 18 seconds East a distance of 2555.75 feet to a point on the North riqht-of-way line of Pine Road as recorded in 0.8. 50, Page 490, among the Public Records of said Collier County; thence departinq said U.S. 41 (State Road 45) South S9 deqrees 09 minutes 45 seconds West alonq said North riqht-of-way line a distance ot 2662.61 feet; thence South 00 degrees 51 minutes 44 seconds East a distance at 70.00 feet to a point on the North line ot Seagate Unit 1 as recorded in Plat Book 3, paqe 85 amonq said Public Records; thence South 89 deqrees 09 minutes 45 seconds West alonq said North line of Seaqate Unit 1 and the South line of said Section 9 a distance of 2496.67 feet to the Southwest corner of said Section 9; thence continue South 89 degrees 09 minutes 45 seconds West a distance of 225 teet more ~ 12C l " or less to a point on the mean hiqh water line established May 15, 1968; thence a Northwesterly direction alonq said mean hiqh water line a distance 15716 feet more or leBs; thence departing said mean hiqh water line South 80 deqrees 29 minutes 30 seconds East and along the Southerly line ot Vanderbilt Beach Road (State Road S62) as recorded in D.B. 15, paqe 121 amonq said Public Records a distance ot 7385 feet more or less to a point on said West riqht-of-way line of U. S. 41 (State Road 45); thence South 00 deqrees 58 minutes 36 seconds East alonq said West riqht-of-way line a distance at 2574.36 feet to the Point of Beqinninq. may be collected utilizinq the uniform method for collectinq such non-ad valorem assessments as provided in section 197.3632, Florida Statutes. 2. A copy of this Resolution shall be mailed by United States mail to the Collier County Property Appraiser, the Collier County Tax Collector, and the state of Florida Department of Revenue by January 10, 1997. 3. It is anticipated that the non-ad valorem assessments for water management operations and maintenance, beautification of recreational facilities and median areas, maintenance of conservation or preserve areas, U.S. 41 berms, street siqnaqe replacements within the median areas and landscaping improvements to U.S. 41 entrances shall be collected over a period of one year.
