RESOLUTION 96-~4
A RESOLUTION BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
PURSUANT TO SECTION 2.7.3.4 OF THE COLLIER
COUNTY LAND DEVELOPKENT CODE AFFECTING
ORDINANCE 88-94 ALSO KNOWN AS THE ISLAND
PINES GARDEN POD, REQUIRING THE SUBMITTAL
OF A POD AMENDMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Island Pineo Garden POD, Ordinance 88-94, adopted on
December 13, 1988, is subject to the provisions of Section 2.7.3.4., of
the Land Development Code (LDC), Time Limits for Approved PUD Master
Plans; and
WHEREAS, the Board of County Commissioners has reviewed the POD
and has determined that the current POD zoning is inconsistent with
certain provisions of the Growth Management Plan (GMP) and the Land
Development Code; and
NOW, THEREFORE BE IT RESOLVED, by the Board of Zoning Appeals of
Collier County, Florida that:
1. The above recitals are adopted herein by reference as if
fully set forth herein.
2. This Resolution shall constitute evidence of compliance
with the review requirements of section 2.7.3.4 of the
LOC.
3. Pursuant to said section of the LOC, the property owner
or agent shall submit an amended POD to the Planning
Services Director prior to June 10, 1997 in order to
cause said POD to become consistent with the Collier
County GMP.
This Resolution shall become effective immediately upon its
approval.
BE IT rUK.n~ RESOLVED that this Resolution be recorded in the
ainutee of this Board and in the records of the Petition for which the
exteneion 18 granted.
