Resolution 1996-495 NOV - 5 199f; RESOLUTION 96- 495 '-... RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS RELATING TO A REQUEST BY COASTAL ENGINEERING CONSULTANTS ON BEHALF OF BENEDICT P. HIRALIA, TRUSTEE, TO PLACE FILL MATERIAL ON PROPERTY HEREAFTER DESCRIBED III COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Sta~utes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance 91-102 as amended) which restricts specific site work such as grading and filling lots until such time that applicable building permits have ~een issued; and WHEREAS, the Board of Commissioners has acknowledged that a building permit for ~ite construction has not been issued to Benedict P. Miralia, Trustee; and WHEREAS, Benedict P. Miralia, Trustee, has agreed to remove all exotic vegetation and non-conforming mobile homes from the subject tract; and WHEREAS, the Board of County Commissioners has found no environmental or wildlife concerns on the upland portion of the subject agriculturally zoned property, and further has acknowledged that Benedict P. Hiralia, Trustee, has received proper work authorization from other applicable regulatory agencies; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF OF COUNTY COMMISSIONERS of Collier County, Florida, that: The written request of Coastal Engineering Consultants on behalf of Benedict P. Hiralia, Trustee, to fill portions of the property as legally described in Attachment "An is hereby approved subject to the following conditions: 1. Prior to the placement of fill on the property, the applicant shall submit a detailed description of the fill and site work activity including a plan indicating fill placement, surface water management and perimeter landscaping, for review and approval to Collier County, consistent with the conceptual plan (Attachment B) . -1- NOV - 5 1~ 2. The permittee shall post a bond or an irrevocable letter of credit in the amount of $25,000.00 to insure that the final grading and re-vegetation of the property meets County standards consistent with Section 3.5.7.6 of the Land Development Code. 3. The filling of this property and the subsequent seeding and landscaping buffer shall be completed within three (3) months of execution of this Resolution. 4. A County vegetation removal permit shall be issued prior to removal of exotic vegetation from the property. 5. The existing potable well shall be elevated above grade or abandoned according to South Florida Water Management District requirements. 6. No construction of any building or structure shall be performed without a building permit pursuant to Section 2.7.6 of the Collier County Land Development Code. 7. Except as provided herein, no other site work, removal of protected vegetation, grading, improvement of property or construction of any type may be commenced prior to the issuance of a building permit where the development proposed requires a building permit under the Land Development Code or applicable County regulations. 8.
