ClIIl IetD: eLIU TO fII 10m IlTllOmel m !LOGI 1lTJ210 mill eoms RESOLUTION NO. 96 -477 OCT 2 2 1996 RESOLUTION AUTHORIZING THE ACCEPTANCE OF AUGUSTA FALLS AND FOUNTAINHEAD SUBDIVISION REPLAT, REPLATS OF PORTIONS OF A PREVIOUSLY RECORDED PLAT KNOWN AS FOUNTAINHEAD SUBDIVISION, AND AUTHORIZING THE VACATION OF A PORTION OF THOSE PLATTED LANDS UNDERLYING THIS REPLAT, PETITION AV-96-021 WHEREAS, the Board of County Commissioners of County, Florida, on November 8, 1994 approved the Fountainhead Subdivision for recording; and Collier plat of WHEREAS, VineyardS Development Corporation is replatting portions of Fountainhead Subdivision, and has filed for replats of said lands; and WHEREAS, except as provided for in this Resolution, these replats do not extinguish or in anyway affect the dedications contained in the previous plat ot these lands; and WHEREAS, Vineyards Development Corporation vacate the Lots, Rights-ot-Way, and drainage easements as depicted on the approved plat of Subdivision, as described in Exhibit "A"; and desires to and utility Fountainhead WHEREAS, as required by Section 177.101, Florida Statutes, notice of the proposed vacation was published in a local newspaper of general circulation in not less than two weekly issues, and all of the other requirements set forth in Section 177.101 Florida Statutes, have been met; and WHEREAS, these parcels, the approved plats of Augusta Falls and Fountainhead SUbdivision Replat, are a part ot a previOUSly approved and recorded plat, Fountainhead Subdivision, and the filing and recording of these approved plats shall not affect access to lots previously conveyed under the Fountainhead Subdivision plat. NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the plats of Augusta Falls and Fountainhead Subdivision Replat, parts of a previously approved and recorded plat, Fountainhead SUbdivision, are hereby approved for recording and the dedications contained on the plats of Augusta Falls and Fountainhead Subdivision Replat are hereby accepted, and those lands described in Exhibit "A" are hereby vacated. Said vacation shall become valid and effective upon recordation of the subja..c replats. BE IT FURTHER RESOLVED AND ORDERED that the Clerk of the Circuit Court shall make proper notation of this action upon the previous plat and record a certified copy of this replat and vacation resolution in the Public Records of Collier County.
