Resolution 1996-464 OCT - 8 1996 RESOLUTION NO. 96- 464 RELATING TO PETITION NUMBER SV-96-J, FOR TWO SIGN VARIANCES ON PROPERTY HEREINAFTER DESCRIBED IN COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection ot the public, and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) which establishes regulations tor the zoning of particular geographic divisions of the County, among which is the granting of variances, and WHEREAS, the Board of Zoning Appeals being the duly elected constituted Board of the area hereby affected, has held a pUblic hearing after notice as in said regulations made and provided, and has considered the advisability of a 10 foot sign variance from the required 150 feet of road frontage for a pole sign to 140 feet, and a 15 foot side yard setback variance from the required side yard setback of 15 feet to -0- feet, as shown on the attached plot plan, Exhibit "AIf, in a C-4 zone for the property hereinafter described, and has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required by said regulations and in accordance with Section 2.7.5 ot the Zoning Regulations of said Land Development Code for the unincorporated area of Collier County, and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled and the Board having considered all matters presented, NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS ot Collier County, Florida, that: The Petition SV-96-J filed by Thomas E. Killen representing Pet Supermarket, Inc., with respect to the property hereinafter described as: Lots 5, 6, and the west 20 feet of Lot 4, Block A, Inomah SUbdivision, as recorded in Plat Book 2, Page 82, of the Public Records of Collier County, Florida -1- OCT - 8 1996 be and the same hereby is approved for a 10 foot variance from the required 150 feet of road frontage for a pole sign to 140 teet, and a 15 foot side yard setback variance from the required side yard setback of 15 feet to -0- feet, as shown on the attached plot plan, Exhibit "A", ot the C-4 zoning district wherein said property is located, subject to the following conditions: 1 - The height of the sign shall be limited to 15 teet and the sign must have a 6 foot ground clearance. 2 - The sign shall be shared by the Pancho's Restaurant and the Pet Supermarket. Their respective copy sizes shall not exceed J x 9 feet for the Pancho's Restaurant and 6 x 8 feet for the Pet Supermarket for a total copy area of 72 square feet. 3 - A minimum ot 200 square teet of pavement around the proposed sign area must be removed and the area must be landscaped. Furthermore, the area located between the front of the building, the sidewalk, the west property line and the loading space must be landscaped. Landscaping plans must be approved by the Planning Services Department prior to the issuance of the sign permit. BE IT RESOLVED that this Resolution relating to Petition Number SV-96-J be recorded in the minutes ot this Board. Commissioner Hancock offered the foregoing Resolution and moved for its adoption, seconded by Commissioner Constantine and upon roll call the vote was: AYES: Commissioner Hancock,.
