:RESOLUTION NO. 96-438
A RESOLUTION AUTHORIZING AND APPROVING THE LELY
AREA STORMWATER IMPROVEMENT FACT SHEET AND THE
EXPENDITURE OF WATER MANAGEMENT CAPITAL FUNDS
FOR THE PRINTING OF SAID FACT SHEET TO BE SENT
TO ALL THE REGISTERED VOTERS WITHIN THE LELY
BASIN AREA.
WIlERE.\S, the Board of County Commissioners on June 25, 1996
adopted Resolution No. 96-296 calling for a non-binding straw vote
on the November 5, 1996 general election ballot to determine if
the qualified electors residing within the boundaries of the
proposed Lely Area Stormwater Improvements Project, approve the
creation of a Municipal Service Taxing and Ben~fit Unit: and
WHEREAS, the proposed Lely Area Stormwater Improvements
Municipal Service Taxin', and Benefit Unit would provide for the
levy of ad valorem taxeB and special assessments to fund the
proposed storrnwater improvements; and
WHEREAS, Section 1~~5. 01, Florida statutes, authorizes the

Board of County Commiss1.oners to place straw vote questions on the
ballot in order to obtai.n expressi-ns of electorate sentiment
regarding matters of substantial interest within the County or a
particular area of the County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Section One. The Board of County Commissioners hereby finds
that the distribution of a Fact Sheet to provide factual
information to all the qualified voters within the boundaries of
the proposed Lely Area Stormwater Improvement Project is in the
best pUblic interests of the citizens of Collier County.
Section Two. The Board of County Commissioners hereby finds
that the questions and answers as set forth in the attached Fact
Sheet attached hereto as Exhibit "A", appropriately provide
information to the citiz"nry and qualified electors residing
within the boundaries of the Lely Area stormwater Improvement
Project in a fair and impartial manner.

approves the Lely Area stormwater Improvement Project Fact Sheet
in substantially the form attached hereto as Exhibit "A".
Section Four. The cost of the Fact Sheet shall be paid from
the Hater Management Capital Fund No. 325.

Why are stonnwater management
improvements planned for the
Lely/Lely-Manor Basin?
There has been a long history of flooding in the Lelyf
Lely-Manor Basin located in the East Naples area.
Conslruction of drainage facilities in that area has
been fragmented. M1UlY parts of the system 811:
inadequate to provide a reasonable level of flood
protection. In the winter "dry season," these !arne
drainage systems tend to overdrain the area. lbis has
caused salt water intrusion problems and unne:essary
depletion of groundwater resources.
In addition, the discharge from the LelyfLely-Manor
Basin flows into :he sensitive waters of Dollar and
Rookery Bays. Discharge of urban stordwaterrunoff
into the wetland systems has upset this area's
ecological balance. It i:; also creating a potenti al
water quality problem.
A key element in implementing the proposed
improvements is the decision on how to pay fer them.
The Board of County Commissioners has directed
that dai\ ~ be submitted to a Straw Ballot vote to
the qualified electlm.(voters) in the LelyfLely-Manor
Basin.

What is the Straw Banot issue?
A straw vote has been placed on the ballot for the
November 5, 1996, general election. The purpose of
the Straw Ballot is to submit to the qualified electors
residing within the boundaries of the proposed Lely
Area Stormwater Improvements Project the
following question:
Yes or No, shall the Board of County
Commissioners create a Municipal
Service Taxing and Benefit Unit for the
Lely Area Storm water Improvements
Project which provides for funding by
the levy of ad valorem taxes and special
assessments for the stormwater
improvements to include generally, but
not limited to, canal improvements,
water level control structures and
improvements and replacements of
culvert crossings within the Lely
Drainage Basin Area?

Where is the project located?
The Lely Area Stormwater Improvements Project is
bounded on the north hy Radio Road; on the east by
CR-9511Le1y Resort Community; on the south by the
wetlands located southwesterly of US-4I; and on the
west by the Moon LakeIKings LakelLakewood
Subdivisions and Bayshore Drive. There are
approximately 18 square miles or I] ,000 acres in the
basin boundaries. (ref'~r to map on back page)
What stormwater management
.
Improvements, are proposed?
Major components as :;hown on thc attached map
include the Lely Main, Lely Branch, County Barn Road
Diversion Ditch and the Lely-Manor System. The
proposals call for two miles of spreader waterways to
restore historical overland flow on the lower end of the
project outlets, 15 miles of enlarging the capacity of
channels for drainagelflood control, and 14 water level
control Structures to provide protection from salt
water intrusion, water quality improvement, wetlands
enhancement and to in crease groundwater recharge.

What is the proposed schedule for
implementing this project?
In order to start the actual construction of the
proposed stonnwater improvements, drainage
easements from property owners, agency penn its and
detailed construction p1l1I1s/bidding documents are
required. Efforts are underway to secure these items
by the Fall of 1997, with construction of Phase I
anticipated during the 1997/98 winter dry season. The
assessments or ad valorem taxes paid by individual
property owners would, with this schedule, appear on
the November 1998 tax bills.
What are the estimated costs of
proposed improvements?
Preliminary estimates of the total cost are
approximately $16 million. It is anticipated that
funding partners such as South Florida Water
Management District/Big Cypress Basin, Florida
Department of Environmental Protection, National
Oceanic and Atmospheric Administration, developers
of large residential projects and the County at large
could help fund about half the cost. The balance
(approximately $8 million) will be funded by property
owners within the basin boundaries by the creation of a
taxing and special assessment benefit unit.
What will be the approximate cost
to individual homeowners?
The total number of developed parcels in the basin is
about 11,000, ofwhicb about 96% are residential type.
More than one-half of these residential units are

assessment methods which are based on the number of
dwelling units and the amount of area covered by
roofs, driveways ond parking lots, there are about
17,000 Equivalent Residential Units (ERU's). This
ERU figure includes multiple ':1uivalents for larger
parcels, commercial propertics a::Id multi-family units.
An "average" homcowner would pay about $100 pcr
year for a 5-year, pay-as-you-go funding program. If
the project is financcd by bonds and the cost :;pread
ovcr 20 years, the approximate cost per "average"
home would be about $70 per year.
If a taxing tmit is to be established and th~ cost for an
"average" homeo'lmer is based on the assessed value
of the homc (c.g., $125,000 less homestead exemption
= $ 100,000 taxable value), the cost per year under the
5-year, pay-as-you-go funding sccnario would be about
$200 per ycar. If the project is fmanced with 20-year
bonds, the cost per "average" homc would be about
S 1 00 per year.

Informational meetings are scheduled to be held at
Lely High School Cafeteria on the following dates:
. Thursday, October 17, at 7 p.m.
. Tuesday, October 22, at 7 p.m.
at which time more detailed information on all aspects
of the project will be available. County staffwiII also
be available to meet with individual homeowner
associations, and to review the impact of the project
upon their development. Additional questions can be
