RESOLUTION NO. 96-429
RESOLUTION !\PPROVING CONTRIBUTIONS IN TilE:
AGGREGATE SUM OF $500,000.00, TO BENEFIT THE
FLORIDA GULF COAST UNIVERSITY, SUBJE':T TO REVIEW
BY FLORIDA GULF COAST UNIVERSITY FOUNDATION, INC.,
FOR FOUR-LANING OF TREELINE BOULEVAHD AND OTHER
PURPOSES.
WHEREAS, Lee CGunty is constructing Treeline Boulevard
located in Lee County, Florida, to accommodate traffic to and
from the Florida Gulf Coast University; and
WHEREAS, Collier County has determined tt\at the residents of
Collier County will benefit from the constru~tion and expansion
of this roadway since it is expected that nany Collier County
residents will travel to and from and attend this University; and
WHEREAS, Collier County has agreed to contribute the sum of
$SOO,OOO.OO for the benefit of the Florida Gulf Coast University
tel be used for the construction of this roadway and other
purposes; and
WHEREAS, the Florida Gulf Coast University F'oundation, Inc.
has agreed to hold the contribution in Bscro...t and release the
funds for disbursement pursuant to this Resolutio~.
NOW, THEREFORE, BE IT RESOLVED BY THE B9ARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA that:
1. The Board determines that there is a public purpose and
pUblic benefit to the residents of Collier County for
the widening of Treeline Boulevard to four lanes since
it is projected that a large number of residents of
Collier County will use this road.
2. The Board finds that Lee County has agreed to construct
Treeline Boulevard as a four-lane highway from
Corkscrew Road to Alico Road, to provide access to the
Florida Gulf Coast University, with a completion date
in late 1998.

3. Collier County shall contribute up to Five Hundred
Thousand Dollars ($500,000) (the "Contribution") to be
used to pay toward and for the construction of a four-
lane Treeline Boulevard from Corkscrew Road to the
entrance of the Florida Gulf Coast University and for
other purposes to be determined by the Board of County
Commissioners. This sum will be paid to the Florida
Gulf Coast University Foundation, Inc. upon the award
of the primary road construction contract by Lee County
or October 1, 1996, whichever is later.
4. The Florida Gulf Coast University Foundation, Inc. has
represented to Collier County that it will hold the
Contributio~ in an interest bearing escrow account and
shall pay the sum of Three Hundred Eight-Nine Thousand,
five HundrE~d Sixty-five Dollars ($389,565.00) to Lee
County upon the completion of the four-Ianing
constructio:1 of Treeline Boulevard. The remaining sum
of One Hundred Ten Thousand Four Hundred Thirty-Five
dollars ($110,435.00) shall remain with Florida Gulf
Coast University Foundation, Inc. and shall be expended
only upon receipt of instructions from the Board of
County Commissioners.
5. Florida Gulf Coast University, Inc. has' represented to
Collier County that it will inform and Ireport at least
quarterly to the Board of County Commissioners
concerning the expenditure of the County I s
Contribution.
6. All cost records and accounts in the possession of or
available to the Florida Gulf Coast University
Foundation, Inc. or Lee County which are related to the
construction of Treeline Boulevard or the County's
contribution shall be subject to review and audit by
representatives of Collier County.
THIS RESOLUTION ADOPTED after motion, second and majority
