REPRESENTING CAN-AMERICAN SHELTER SEAGATE CORPORA- TION REQUESTING A VARIANCE FROM THE COASTAL CON- STRUCTION CONTROL LINE (CCCL) FOR CONSTRUCTION OF A DUNE ZONE WALKOVER, REMOVAL OF AUSTRALIAN PINES, AND OUNE RESTORATION AT CLAM PASS COUNTY PARK. WHEREAS. Gee & Jenson, Inc.. agent for Can-American Shelter Seagate Corporation, has requested a variance from the COBstol Construction Control Line (as required by Ordinance 75-19) for the construction of a boardwalk, dune walkway, and beach facility to benefit the Regency Hotel guests and to facilitate access by the public to Clam Pass County Park with a legal description 8S follows: All that part of Sections 8 & 9, Tovnship 49 South, Range 25 East, Collier County, Florida, lying Bouth of Clam Pass. west of Outer Clam Bay and east of the Culf of Mexico. Mean High Water Elevation 1.1 feet. Said land situate, lying and being in Collier County; and WHEREAS, the petitioner requests a CCCL variance to construct a dune zone walkover for the public beach at Clam Pass County Park; and WHEREAS. the walkqver will tie into the County system currently being constructed using grant funding from the Florida Department of Natural Resources; and WHEREAS, this plan was previously approved and permitted for a more southern location and crossing of Clam Bay. This application is to move the facility to a more northern. widt~r, location. The Florida Department of Natural Resources has already approved the modification of permit A-C0-89; and WHEREAS, the Natural Resources Management Department (NRMD) has reviewed the petition, examined the site. and discussed preservation/restoration of the dune zone natural resourc"s with Hr. David Decker of Gee & Jenson. Inc. NOW. THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Collier County. Florida, that Petition CCCL-86-7C 1s granted subject to the conditions listed below: 1. The dune zone in the vicinity of the beach facility (abou~ 100 feet north and south of the facility) shall: (a) Rave all Australian pines seaward of the eeeL removed pursuant to Ordinances 82-113 and 82-37i lOOK 095 m~ 378 'J, ,.'.~\: .. ,;.:' :';~. ..\", ....,. .-.'\' ~~~'l : -~..:~:, , lOOK :: 095 FII[379 July 22, 1986 (b) Be planted ....ith native dune vegetation to retard erosion and tie the proj ect into the current Collier County dune restoration project in the area (as 1s also required by Florida Department of Natural Resources permit condition "mil); (c) Have mulched path....ays provided to tie in the proposed dune walkover to the system of walkovers and pathways currently being constructed by the County NRMDj 2. No equipment will be stored in the dune zonej 3. The petitioner will notify the NRMD prior to beginning work in front of the CeeL and will apply to NRMD for vehicle on the beach permit (if necessary) pursuant to Ordinance 74-31.
