Resolution 1996-420 SEP I 0 1996 RESOLL'TION NO. 96- 420 RELATING TO PETITION NUMBER V-96-lJ, FOR VARIANCES ON PRO:?EWry HEREINAFTER DESCRIBED IN COL:GIER COUNTY, FLORIDA. \iHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforl;e zoning and such business regulations as art! necessary for the protec':ion of the public; and HHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) which establishes regulations for tIle zoning of particular gcc)graphic divisions of the County, among which is the granting of varianc:es; and HHEREAS, the Board of Zonil1g Appeals, being the duly elected constituted Board of the area hE~reby affected, has held a public hearing after notice as in said regulations made an(1 provided, and has consiclered the advisability of il 5 foot variance from the required front yard setback of 25 feet tc> 20 feet; a 10 foot variance from the requil~ed 20 foot landscape buffE!r along U.s. 41 to 10 feet for a distance of 130 feet; a 20 foot variance from the required 20 foot landscape buffer to -0- feet fOI' a distance of 160 feet along the southeast corner of the property on U.S. 41, as shown on the attached plot plan, Exhibit l'AII, in a C-] zone for the property hereinafter described, and has found as a matter of fact that satisfactory provi~;ion and arrangement have teen made concerning all applicable matteI"S required by said regulations and in accordance with Section 2.7.5 of the Zoning Regulations of said Land Development Code for the unincorporated area of Collier County; and HHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled, and the Board having consiclered all matters presented; now THEREfORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS of Collier County, Florida, that: The Petition V-96-1J filed by Laura Redondo Ryan of Wilson, Miller, Barton & Peek, Inc., representing James Laskill, President of -1- IOO'( (Jon ,lO' 125 SEP 1 0 1996 Barnett Bank Naples, ......ith respnct to the property hereinafter described as: Lot 124, Naples Grove and Truck Companies Lit'tle Farms No. 2, as recorded in Plat Book l_, Page 27, of the Public Records of Collier County, Florida be and the same hereby is apprc>ved for a 5 foot val:,iance from the re~lired front yard setback of 25 feet to 20 feetj a 10 foot variance fron the required 20 foot landscape buffer along U.S. 41 to 10 feet for a distance of 130 feet; a 20 foot variance from th(! required 20 foot landscape buffer to -0- feet for a distance of 160 feet along the sout:heast corner of the property on U.S. 41, as shown on the attached plot plan, Exhibit IIAI', of the C-3 zoning district wherein said property is located, subject to the following condition: In the event that the site is redeveloped, it must comply with all code requuirement.g including setbacks, landscaping and buffer requirements.
