RESOLUTION FOR PETITION AV 96-006 TO VACATE A
PORTION OF A 50-FOOT RIGHT-OF-WAY PLATTED AS
WINIFRED AVENUE ON THE PLAT OF TAHIAMI
HEIGHTS SUBDIVISION AS RECORDED IN PLAT BOOK
1. PAGE 29, OF THE PUBLIC RECORCS OF COLLIER
~OUNTY, FLORIDA.
WHEREAS, pursuant to Section 177.101, 336.09 and 336.10,
Florida statutes, J. E. Carroll, as agent for owners, Peter
Jenks, J. E. Carroll and Marion Putnam, dCI hereby request the
vacation of a portion of a 50-foot road right-of-way located on a
portion of the plat of Tamiami Heights Sul~ivision ae recorded in
Plat Book 1, Page 29, of the Public Recorcls of Collier County,
Florida; and
WHEREAS, the Board has this day held a pUblic hearing to
consider vacating a portion of said plat as more fully described
below, and notice of said public hearing to vacate was given as
required by law; and
WHEREAS, the granting ot the vacatiorl will not adversely
affect the ownership or right ot convenierlt access of other
property owners.
WHEREAS, the petitioners are requesting vacation of the
public ingress/egress right to a portion of the 50-foot road
right-of-way, but retain the public utility and drainage rights
with no maintenance responsibility by Collier County.
WHEREAS, the vacation and abandonment of the 50-foot road
right-of-way platted as Winifred Avenue located on a portion of
the plat of Tamiami Heights as recorded in Plat Book 1, Page 29,
of the Public Records of Collier County, Florida, would benefit
the general public welfare and is in the test interest of the
public in the following particulars:
1. Any future access to state Road 90 and Winifred Avenue
will be subject to appropriate Collier County and/or Florida
Department of Transportation permissive use permits.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the following be
and is hereby vacated:
See Exhibit "An attached to and incorporated herein.

BE IT FURTHER RESOLVED, that the Clerk is hereby directed to
advertise the adoption of this Resolution once in a paper of
general circulation in the County within 30 days following its
adoption.
BE IT FURTHER RESOLVED, that the Clerk is hereby directed to
record this Resolution, the proof of publi.cation of the notice of
pUblic hearing, and the proof of publicatlon of the notice of
adoption of this Resolution in the Public Records of Collier
County, Florida, and to make proper notations of this vacation on
said plat.

distance of 50.00 feet to the northerly right-of-way line,
Thence South 89026'23" West a distance of 140.95 feet,
Thence South 00019'27" East a distance of 6.09 feet to the
northerly right-of-way line of S.R. 90 (U.S. 41), Tamiami Trail,
Thence South 52000'49" East a long said right-of-way a distance
of 70.46 feet to the intersection with the extension of the
southerly right-of-way of Winifred Avenue,
