Resolution 1996-340 AUG - 6 1996 RESOLUTION NO. 98- 340 RESOLUTION TO AUTHORIZE REDUCTIONS OF SPEED LIMITS TO TWENTY FIVE MILES PER HOUR (25 MPHI ON DESICNATEO PLATTED LOCAL RESIDENTIAL SUBDIVISION ROADWAYS THAT ARB THEN DEDICATED TO PUBLIC USB WITHIN COLLIER COUNTY, SUBJECT TO MANDATORY PREREQUISITES. WHEREAS, Section 316, Florida statutes, and collier county Ordinance NO. 91-25 authorizes the Board of County commissioners to alter or establish speed limits on roads under Its Jurisdiction; and WHEREAS, many local subdivIsion roadways fall under the JurIsdiction of the Board of County Commissioners; and WHEREAS, In accordance with SectIon 316, Florida Statutes, and collier county Ordinance No. 91-25, many local platted residential subdivision roadways are constructed with lane widths In anticipation of accommodating only low traffic volumes traveling at low speeds; and WHEREAS, the Board of County Commissioners has set precedents by establishing a 25 MPH speed limit on many Of the platted local residential subdivision roadways within Collier COunty; and WHEREAS, public notification has been advertised tv/o (21 weeks prior to the Collier County Board of County Commissioners' public meetIngs held to consider the proposed speed limit reductions to 25 MPH; and WHEREAS, Inspections promulgated by requests of citizens to lower the speed limits within residential areas have recently confirmed that many of the roadways within older subdivisions In the County have been constructed below the current County subdivision standards and which roads are utilized concurrently by vehicles, pedestrians, and cyclists, and which roads have been constructed for only low.volume, low-speed travel; THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, that 1. Speed limits on roads may be lowered, when determined by the County's Transportation Department to be warranted, to 2S MPH on the platted and accepted local subdivision roadways, Implementation of those speed zones by the Transportation Department shall be subject In each Instance to having received a citizens' petition meeting County requirements and lOOK 000 PAIl 24 AUG - 6 1996 requesting same, In accordance with englneerlnll studies, gaining Board of County Commissioner approval, and subject to availability of adequate monetary and personnel resources. 2. The effective date of each speed limit reduction by road segment shall not be until al Board of county Commission approval; and bl posting of appropriate speed limit sign age; and cl Written notification of each such speed limit reduction has been delivered to the Collier County Sheriff'S Office. 3. The County.s Transportation Department will review each respective residential roadway upon receiving a citizens' petition for such action from the residents requesting that the respectIve speed limIt be lowered. After the completion of traffic engineering studies as then required by Florida statutes and/or Collier County Ordinance, the collier County Transportation Department will make Its recommendation and the Board of County Commission will take action to deny the request, or to approve the request and authorize the Transportation Department to commence lowering the respective speed limits, subject to providing written notification of each such reduction to the Collier County SheriffS Office. 4. Authorization Is hereby given to the CDunty's Transportation oepartment to erect appropriate speed limit Signs In accordance with each respective speed limit reduction caused pursuant to this Resolution, and In accordance with section 316, Florida Statutes, and with Collier County Ordinance No, 91- 25, as then amended. 5. Notwithstanding any other provision herein, speed limits shall remain at thirty miles per hour (30 MPHI on local subdivision roaClviays with areas of Collier County now or hereafter platted as "The Golden qate Estates', and also on all roadways then platted or then accepted as "local county roadways" provided such roads are neither within a subdivision nor are then subject to the establishment of different speed limits In accordance with applicable Florida statutes and/or with County Ordinance No. 91-25, as then amended. 6, The Clerk to the Board shall provide a true copy of this resolution to the Collier County Sheriff'S Office, lOOK 000 PA&' 25 -. ,.",."
