Resolution 1999-318 16 8 RESOLUTION NO. 99-?_3.U.L A F~ESOLUTiON TO DECREASE THE EXISIING SPEED LIMIT FROM THIRTY MILES [-'ER HOUR (30 MPH) TO TWENTY-FIVE MILES PER HOUR f25 MPH') AND TO PROHIBIT TilE OPERATION OF TRUCKS AND OTHER COMMERCIAL VEHICLES HAVING A RATED LOAD-CARRYING CAPACllY IN EXCESS OF ONE (1)TON FROM THROUGH MOVEMENTS ON CERTAIN STREETS Ir',l THE ESTEY AVENUE AREA AND BROOKSlDE AREA NEIGHBORHOODS. VVHEREAS. Chapter 316. Florida Statutes, permits the Board of County Commissioners (BCCI to aller or establish a twenly-flve mile per hour f25 MPH) speed lind on residential slreets; and WttEREAS Ch,g:F.~r 31f~, Florida StatuIes. f)errmts Ihe BCC t<} rf;fj~l;]le r:r prohibd any c. lassd~cat;on or k~nc: r)f traffiG found ~0 bo ~ncompatlble with lhe r~urm~11 ;1nd $,[lle movemenls of Iraffic on roads and slreets under ~ts iurisdiction; and WHEREAS, an engineering study by the Collier County Transportalion Services Department indicates that existing speed limits and excesswe Ihrough-lruck Iralfic are riel compatible with the ex~shng road conditions through the Estey Avenue area and Ihe Brookside area neighborhoods since the filreets are in frilly developed rnsidenhal areas and lbo pavement width, radii, and right-of-way width are not conducive to through truck-traffic: and WHEREAS, Estey Avenue (from Airport-Pulling Road to Holiday Lane), 14Duse Avenue. Sleeves Avenue, Hawthorne Court, North Randall Circle. South Randall Circle, Terrace Avenue. Shadowlawn Drive, Pine Streel (from Davis Boulevard to Esley Avenue), Pine Lane, t4arbor Road, Circle Drive. Mockingbird Lane, Park Way, Rainbow Drive. Chrislophnr CoHrt. Holiday Lane, Harbor Lane. Harbor Place Brooksde Dave. Sunset Larle. Bacb~zon Lan~;. THEREFORE. BE IT RESOLVED BY THE BOARD OF COUNTY COblMISSIONERS OF COLLIER COUNTY. FLORIDA. thai the speed limit shall be reduced from Ihirty miles per hour (30 MPH) and ~s hereby established at twenty-five miles per hour (2,5 MPH) on lhe following streets: Estey Avenue (from Airport-Pulling Road to Holiday Lane). House Avenue. Sleeves Avenue. Hawthorne Courl. North Randall C~rde. Soulh Randall Circle Terrace Avenue, Shadowlawn Drive. Brookside Dr,ye, Sunset Lane, Barbizon Lane, Delmar Lane, and Embassy Eane BE IT FURTHER RESOLVED thai the operation of trucks and oll~er cammercial vehicles hawng a rated Ioad-carrymg capacity in excess of one (1) ~on is hereby expressly prohibilod on the following streets: Brooks~de Dnve, Pine Street north of Terrace Avenue. Shadowlawn Drive north of Terrace Avenue. and Estey Avenue. BE IT FURTHER RESOLVED lhat authorization is hereby given lo the Collier Courtly Transportahon Serwces Department to erect twenty-five mile per hour (25 MPI4) speed limit signs and vehicular load limd signs in accordance wilh Chapter 316, Sections 316.006. 316008. 316.189. Florida Slatutrm. Collier Counly Ordinance No. 91 ~25 BE IT FURTHER RESOLVED that a copy of this Resolution shall be lendered to the Collier County Sheriff's Office for enforcement of the speed and load limits established herein.
