"-~ A RESOLUTION SETTING THE DATE, TIME AND PLACE FOR THE PUBLIC HEARING ON 1HE TENTATIVE ASSESSMENT ROLL FOR THE NAPLES PARK AREA DRAINAGE IMPROVEMENTS MUNICIPAL SERVICE BENEFIT UNIT. WHEREAS, the Board of County con~iBBioner8 on July 18, 1995 adopted Collier County Ordinance No. 95-44 which amends Ordinance No. 86-37 by providing the procedure for the levy and collection of the special assessments; and WHEREAS, the Board of County Commissioners on July 16, 1996 adopted Resolution No. 96-~ which replaces Resolution No. 95-476 creating the Naples Park Area Drainage Improvements .Municipal Servica Benetit Unit; and WHEREAS, the aforementioned resolution, did cot forth that ths cost o! the stormwater drainago improvements within the Unit ,.hall be paid by the levy and collection o! special assessments against the benefited properties within the Unit; and WHEREAS, the Board of County Commissioners on July 16, 1996 ndopted Resolution No. 96-..J.U initiating a program for the purpose of providing stormwater drainage improvements within the Naples Park Area Drainage Improvements Municipal Service Benefit Unit and c:reatinq the Naples Park Area Drainage Improvements Special J~8BeBsment District. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE~ This Resolution is adopted pursuant to the ~lroviBions of Section 125.01, Florida statutes, Collier County Ordinance No. 86-37, as amended by Ordinance No. 95-44, and other applicable proviaions ot law. SECTION TWO. It is hereby found ~nd determined as follows: A. Said Resolution created the Naples Park Area Drainage Improvements Special Assessment District and directed "he County's Consulting Enginser for the Project to prsparo in triplicate the preliminary plans, opecifications, cost estimate of the project lmd Tentative Assessment Roll. 8. The preliminary plans, specifications, cost estimate of the project and Tentative Ass.anment Roll have been preparQd by the County's Consult~~g Engineer tor the Project and are on file in the Office of the Clerk to the Board. ~~ THRIB. The 3rd day of Sopteaber, 1'" at 9:00 o'clock A.M. at the Board Meeting Roc.m, Third Floor, Administration Building, Collier County Government Center, 3301 Eaot Tamiami Trail, Naples, Florida JJ962, is hereby fixed as the date, time and place at which the Board will meet and receive the written objections of the owners of the properties to be assessod, or other persons interested therein, to adopt a Resolution approving the Tentative Assessment Roll and ~rdering the construction of the assessable improvements. The Clerk shall cause the notice of ouch public hearing to consider the adoption of the Tentative Assessment Roll to be mailed first class mail to each of the property owners on the Tentative Assessment Roll at the address provided for on said roll and to be published one time in the Naples Daily News, a newspaper published in Collier County and circulating in the Unit, not lesa than 15 calendar days from such pUblication (excluding Saturdayn, Sundays and legal holidays)prior to said date of the pUblic hearing. All affected property owners have a right to appear at the hearing and to file written objections to the adoption of a resolution approving the Tentative Assessment Roll with the Board within 20 days of this notice based upon the grounds that it contains items which can not be properly assessed against property, that the computation of the special assossment is incorrect, or there is a default or defect in the passage or character of the resolution, or the :rentative Assessment Roll is void or voidable in whole or part, o~ that it exceeds the power ot the Board. At the completion of the hearing, the Board shall either annul or sustain or modify in whole or in part the Tentative Assessment Roll. Further, the Board may adopt an Approving Resolution which shall approve the plans, specifications, cost estimates and Tentative Assessment Roll, inclu~inq the method of assessment, with such amendments as it deems just and right, repeal or confJrm the Initial Resolution with such amendments, if any, as may be deemed appropriate by the Board. All objections to the Approving Resolution shall be made in writing, and flIed with the Clerk at or before the time or adjourned time of such hearing.
