'5-(76. WHEREAS, the Board of County Commissioners on May 16, 1995 conceptually approved the design and construction of stormwater drainage improvements for the ditch enclosures in the vicinity of 91st/92nd Avenue North and 8th street within the Naples Park Area; and WHEREAS, the Board of County Commissioners approved this project to be funded by special assessments against the benefited properties within the Unit based on a per acre assessment method; and WHERZAS, the Board of County Commissioners on June 4, 1996 tentatively awarded the contract for construction of the stormwater drainage improvements subject to the public hearing and adoption ~f the appropriate resolutions as prescribed by law and Collier County Ordinance No. 86-37, as amended; and WHEREAS, the Board authorized the County Staff to do all things Mcassary to have this project completed as soon as posaible; and WHEREAS, the Board has determined and found'that the creation of the Naples Park Area Orainage Improvements Municipal Service Benefit Unit is needed for health, safety and to enhance the general area. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE. This Resolution is adopted pursuant to the provisions of Collier County Ordinance No. 86-37, as amended by 1 ~OO~ 000", 45 JUL 1 6 1996 Ordinance No. 95-44, and other applicable provisions of law. SECTION TWO. It is hereby found and determined as follows: A. The municipal service benefit unit created shall be officially known as the Naples Park Area Drainage Improvemente Municipal Service Benefit unit (hereinafter referred to as "Unit"). B. It is necessary for the continued pre.ervation of the health, welfare, convenience sad safety of the citizens and inhabitante of the Naples Park Area to provide for the construction of the stormwater drainage improvements in the vicinity of 91st/92nd Avenue North and sth street (the "Project") described in Exhibit "A" attached hereto and incorporated herein. 81CTION TBRII. The Naplee Park Area Drainage Improvements Municipal Service Benefit Unit shall comprise all those lands located in Collier County, Florida, as depicted on Exhibit "B" attached hereto and being more particularly described as tollows: All ~hose certain lands lying within portions of Sections 28 and 13, Township (8 South, Range 25 East, Collier County, Fl"r.lda, and being further described as follows, all of: u~it No.1, Naples Park as recorded in Plat Book 1, Page 106, and; subdivision of Block 1, Unit No.1, naples Park, as recorded in Plat Book (, Page 5, and; Replat of Blocks 4 and 5, Unit No.1, Naples Park, rocorded in Plat Book 4, Page 6, and; Unit No. 2, Naples Park as recorded in Plat Book 2, Page 107, and,: Unit No. 3, Napl"'!s Park as recorded in Plat Book 3, Page 5, and; Unit No. 4, Naples Park as recorded in Plat Book 3, Page 7, and; Unit No. 5, Naple~ Park as recorded in Plat Book 3, Page 16, and; Unit No. 6, Naples Park as recorded in Plat Book 3, Page 15, and; Coventry Square as recorded in Plat Book 23, Pages 65-66; together with all those certain lands lying within Section 33, Township 48 South, Range 25 East, being bounded on the: 2 &OOK 000",\ 46 -- - .~- - -- JUL 1 6 1996 North by the South right-of-way line of 91at Avenue; South by the North right-of-way line of Vanderbilt Beach Road; East by the West right-of-way line of U.S. 41, N. Tamiami Trail; and Wsst by the East right-ot-way line of Vanderbilt Drive. SZCTIOR FOUR. All objections, if any, to the adoption of this Resolution creating the Naples Parks Area Drainage Improvemsnts Municipal Service Benefit unit shall be made in writing and filed with the Clerk at or before the time or adjourned time of the public hearing. The adoption of this Resolution shall be the tinal adjudication of the issues presented thereby unless proper steps shall be initiated in a court of competent jurisdiction to socure re1\ef Iii thin twenty (20) days from the date of the Board action ~t this Resolution. iIQJ~~'~ Collier County Resolution No. 95-476 is hereby .uper"eQ~U and repealed in its entirety.
