WHEREAS, ColUer County, Florida entered into an agreement with Avatar Propertiea Inc. rIP November 15, 1983 to accept .a Trustee 1,061.5 acres of r..l property i~l C.,lden Cat, gstates for the PUCPOU8 of ..le to the public (hereinafter r.f.rr.~ to .s w1983 AgreementW; and WEREAS. Collier County, ;'lorlda accepted the acreage In phUflS; Phase 1 on November 15, 1983, Phas.s II and III on February 16, 1988 and Phases tV and V on June 13, 1989; such conveyances have been rf!corded In the Public Recorda of Collier County. Florida; and WHEREAS, on April 5. 1988, the Board of County Commissioners approved the marketing procedures for the sale of the Golden Gat~ Estat~s property conveyed by Avatar Properties lne, 'Thereupon the Real Property Hanagement Department has been actively marketing the property (Phases I through V) for sale to the general public; and WHEREAS, there is a benefit to the County and to the public if the administrative procedures concerning the Real Estate Sales Agreement documents and Statutory Deeds are expedited, while maintaining the safeguards of staff and legal counsel review of such documents; and WHEREAS, the Golden Gate Estates Land Trust Committee at their Hay 20, 1996 lIeeting recognized the benefit of reducin;~ time for approvel and the subsequent closing process on reviewed Real Estate Sales Agreements and Statutory Deeds and recommended that each proposed purchase of property that Ileets the criteria of the 1983 Agreement be considered approved by the Committee unless being reserved pursuant to Board of County Commissioners action; and WHEREAS, the Board of County Commissioners also recognizes the benefit of reducing time for approvals and the subsequent closing process on reviewed and approved Real Estate Sales Agreements and Statutory Deeds, lOOK 000 PA'.! 277 - JUL I 6 1996 NOli, THEREF:lRE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY. n.oRIDA that: 1. The Board of C01.lncy C01lllinioners does hereby authorize the Chatman of the Board of County COllUd..lonera to execute Roal Estate Sal.. Agreements and Statutory Deeda resulting froll the Agreement dated November 15, 1983 and the County's adminiatration of .~ch Agree.ent, whereupon the R..I Eatate 5.1.. Agr..menta and St&tutory D..d. have been previously approved by the Real Property Hanagement Department, the F1n.nc~ Dep.~~.nt and the County Attorney. 2. The authorization of the Chairman to execute Real Estaee Sales Agreements and Statutory Deeds hereunder shall extend solely for the tenure of the current Chairman.
