Resolution 1996-302 JUN 2 5 1996 RESOLUTION NO. 96- 302 A RESOLUTION ORDERING AND CALLING A REFERENDUM ELECTION TO BE HELD NOVEMBER 5, 1996 WITHIN COLLIER COUNTY TO DETERMINE IF THE QUALIFIED ELECTORS APPROVE AN ADDITIONAL ONE-HALF OF ONE PERCENT LOCAL GOVERNMENT INFRASTRUCTURE DISCRETIONARY SALES SURTAX FOR A PERIOD NOT TO EXCEED FOUR YEARS TO FUND THE ACQUISITION OF LAND PRIMARILY IN AND AROUND THE URBAN AREAS OF COLLIER COUNTY FOR THE PURPOSES AS SET FORTH IN SECTION 212.055(2), FLORIDA STATUTES, TO PRESERVE THE BIODIVERSITY, AIR AND WATER QUALITY, GROUNDWATER RECHARGE, FLOOD CONTROL, AESTHETICS, PROVIDE PASSIVE RECREATION AREAS AND DENSITY REDUCTION. WHEREAS, the Board of County Commissionsrs on June 11, 1996 adopted Collier County Ordinance No. 96-~, which provides for an additional one-half of one percent local government infrastructure discretionary sales eurtax to be collected for four (4) years, commencing February 1, 1997 and ending January 31, 2001; and WHEREAS, pursuant to Section 212.055(2), Florida Statutes, and Collier County ordinance No. 96-~, such additional one-half of one percent local government infrastructure discretionary sales surtax levy is subject to referendum approval by a majority vote of the qualified electors of Collier County voting in a referendum election to levy such additional one-ha~: of one percp.~t sales tax to fund the acquisition of lands primarily in and around the urban areas of Collier County to provide for biOdiversity, passive recreation, preservation of air and water quality, groundwater recharge, tlood control, aesthetics, and density reduction; and WHEREAS, the Board of County commissioners of Collier County, Florida, finds it to be in the best interests of the citizens of Collier County to call a referendum election. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: BECTIOR ORE. REFEREllDUM ELECTION CALLED A referendum election be and is hereby ordered and called to be held on November 5, 1996 for the purpose of submitting to the qualified electors of Collier County the question of whether the 1 100\ (jon", 157 JUN 2 5 1996 levy of an additional one-half of one percent local government infrastructure surtax shall be approved. BECTIOH TWO. PERSOKS BBTITLED TO VOTE The persons entitled to vote in the referendum election shall be all the qualified electors residing within collier County, Florida. BECTIOK THREE. POLLIHG PLACEB. ELECTION OFFICIALS AND HOURB OY ELECTION The election shall be held at the polling places designated in each precinct within Collier county, Florida, as a county-wide election. The election shall be conducted by election officials appointed by the Supervisor of Election pursuant to applicable general law. The polls shall be open at the voting places from 7:00 A.M. to 7:00 P.M. on the day of the election. BECTION YOUR. YORK OY BALLOT A) The ballot to be used in said election shall be in substantially the following form: OFFICIAL BALLOT REFERENDUM ELECTION ON ADDITIONAL ONE-HALF OF ONE PERCENT LOCAL GOVERNMENT INFRASTRUCTURE DISC':'ETIONARY SURTAX (SALES TAX) Shall an additional one-half of one percent surtax (sales tax) pursuant to Ordinance No. 96- 34 be levied in Collier County for a period of 4 years, commencing February 1, 1997 and ending January 31, 2001, to purchase lands primarily in and around the Urban Areas of Collier County tor passive recreation, conservation and protection of natural resources and to preserve biodiversity, air and water quality, groundwater recharge, flood control, aesthetics and density reduction? FOR the One-Half of One Percent Sales Tax AGAINST the One-Half of One Percent Sales Tax B) The Supervisor of Elections shall include on all ballots and absentee ballots such instructions to voters as are necessary and required pursuant to general law. KOTICE OY IlLIICTION The Clerk of this board shall publish a notice of the 2 lOOK 000 PI'.! 158 JUN 2 5 1996 referendum election in the Naples Daily News, a newspaper of general circulation published in Collier County, Florida. There shall be at least thirty (30) days notice of eaid election, with publication to be made at least twice, once in the fifth week and once in the third week prior to the week in which the referendum is to be held. Said notice shall be in substantially the following fOrDl: BOTICE OY RDEREllDUM ELECTIOll NOTICE IS HEREBY GIVEN, that a referendum election will be held on November 5, 1996, in Collier County, Florida, to determine if the qualified electors residing within Collier County approve an additional one-half of one percent local government infrastructure discretionary sales surtax to be levied for a period of four (4) years, commencing on February 1, 1997 and ending on January 31, 2001, to fund the land acquisition costs primarily in and around the urban areas of Collier County for the purposes as set forth in section 212.055(2), Florida statutes, to preserve the biodiversity, air and water quality, groundwater recharge, flood control, aesthetics, providing passive ~ecreation areas and density reduction. The election shall be conducted by election officials appointed by the Supervisor of Elections pursuant to applicable general law. The polls will be open at the polling places on the date of said referendum election from 7:00 A.M. to 7:00 P.M. on the day of the election. All qualified electors reeiding within Collier County are entitled to vote in said referendum election. Absentee voting may be permitted upon compliance with applicable provisions of State law.
