RBSOLUTION NO. t,-~ A RESOLUTION CALLING A STRAW VOTE TO BE PLACED ON THE BALLOT AT THE GENERAL ELECTION TO BE HELD ON NOVEMBER 5, 1996, TO DETERMINE IF THE QUALIFIED ELECTORS WITHIN THE PROPOSED LELY AREA STORHWATER IMPROVEMENTS PROJECT APPROVE THE CREATION AND LEVY OF AD VALOREIl TAXES AND SPECIAL ASSESSMENTS FOR STORHWATER IMPROVEIlENTS WITHIN THE PROPOSED DISTRICT. WHEREAS, ths Board of County Commissioners on June 4, 1996 approved a straw vote to be placed on the ballot for November 5, 1996 general election to determine if the qualified electors within the propoeed Lely Area Stormwater Improvements Project approve the creation and levy of ad valorem taxes and special assessments to fund stormwater improvements within Lely Drainage Basin Area; and WHEREAS, Section 125.01, Florida Statutes, authorizes the Board of County Commissioners to place straw vote questions on the ballot in order to obtain expressions of electorate sentiment regarding matters of substantial interest within the County or a particular area of the County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: aBOTIOR 0101. STRAW VOTB CALLBD A straw vote is hereby called to be placed on the ballot for the November 5, 1996 general election for the purpose of submitting to the qualified electors residing within the boundaries of the proposed Lely Area Stormwater Improvements Project the following question: Shall the Board of County Commissioners create a Municipal Service Taxing and Benefit Unit for the Lely Area Stormwater Improvements Project which provides for funding by the levy of ad valorem taxes and special assessments for the stormwater improvements to include generally, but not limited to, canal improvements, water level control structures and improvements and replacements of culvert crossings within the Lely Drainage Basin Area? 1 nnn ".... ILECTION OFFICIALS AND BOURS OF ELECTION The election shall be held at the polling places designated in each precinct within the boundaries of the area described above in Section Two of this Resolution. The election shall be conducted by election officials appointed by the Supervisor of Election pursuant to applicable general law. The polls shall be open at the voting places from 7:00 A.M. to 7:00'P.M. on the day of the election. There shall ba at least thirty (30) days notice of said election, with publication to ba made at least twice, once in the fifth week and once in the third week prior to the week in which the referendum is to ba held. The polle will be open at the polling places on the date of eaid general election from 7:00 A.M. to 7:00 P.M. on the day of the election. All qualified electore residing within the boundaries of the proposed Lsly Area stormwater Improvements Project as described herein may vote on eaid straw ballot. Absentee voting may be permitted upon compliance with applicable provisions of state law. DWIGHT E.
