RESOLUTION FOR P,~ITION AV 96-010 TO VACATE,
RENOUNCE AND DIS~!AIM THE RIGHTS OF THE COUNTY
AND PUBLIC TO THE ROAD RIGHT-OF-WAY INTERESTS
IN A PORTION OF AN EIGHTY FOOT (80') ROAD
RIGHT-OF-WAY KNOWN AS TRAIL BOULEVARD, AS
RECORDED IN OFFICIAL RECORD BOOK 637, PAGE
1161, IN THE PUBLIC RECORDS OF COLLIER COUNTY,
FLORIDA.
WHEREAS, pursuant to Ssctions 336.09 and 336.10, Florida
Statutes, John M. Passidomo as agent for owner, STS Properties,
has requested, that the Board vacate, renounce and disclaim the
rights of the County and Public to the road right-of-way interests
in a portion of an eighty foot (80') road right-of-way known as
Trail BOUlevard, as recorded in Official Record Book 637, Page
1161, in the Public Records of Collier County,

Florida and as
described in Exhibit "A"; and
WHEREAS, the Board has this day held a public hearing to
consider such action regarding the road right-of-way interests in
a portion of an eighty foot (80') road right-of-way known as Trail
Boulevard being more fully described below, and notice of said
public hearing to vacate, renounce and disclaim the road
right-of-way interests was given as required by law; and
WHEREAS, the granting of the petition will not adversely
affect the ownership or right of convenient access of other
property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Easterly sixty
(60) feet of the eighty (80) foot right-of-way of Trail Boulevard
as more particularly described in Exhibit "A" attached hereto and
incorporated herein is hereby vacated.
BE IT FURTHER RESOLVED, that the vacation of the easterly
sixty (60) feet of the eight (80) foot right-of-way of Trail
Boulevard as described in Exhibit "A" is subject to the adjacent
property owner, STS Properties, entering into permissive right
agreements with the Collier County Water-Sewer District and
Florida Power and Light Company and receipt of a cross-access

agreement with the adjacent property owner (Doane-Kempfer Joint
Venture), within twenty (20) days from the date of the adoption Of
this Resolution.
BE IT FURTHER RESOLVED, that upon receipt by the County
Attorney of the fully executed and recorded permissive right
agreements with the Collier County Water-Sewer District and
Florida Power and Light Company and the crose-accees agreement
with Doane-Kempfer Joint Venture, the Clerk is hereby directed to
pUblish, one ~ime, notice of the adoption of this Resolution
within 30 days of the date of the Resolution, in a newspaper of
general circulation pUblished in the County; and
BE IT FURTHER RESOLVED, that the proof of pUblication of

notice of the public hearing, the proof of pUblication of the
notice of tha adoption of this Resolution and this Resolution
shall be recorded by the Clerk in the Official Recorda of Collier
County, Florida, and make the proper notations of this vacation
and dedication on said plat.
This Resolution adopted this .th Jay Of June, 1996, after
motion, second and majority vote.
