A RESOLUTION APPROVING THE
TRANSMITTAL OF THE MARCO ISLAND
MASTER PLAN AS AN AMENDMENT TO THE
COLLIER COUNTY GROWTH MANAGEMENT
PLAN TO THZ DEPARTHENT OF CCMMUNITY
AFFAIRS (DCA) ACCORDING TO THE
PROCEDURES AND CRITERIA OUTLINED IN
SECTION 163. n84, FLORIDA STATUTES
AND RUbE 9J-5, FLORIDA
ADMINISTRATIVE CODE.
WHEREAS, the Local Government Comprehensive Planning and Land
Development Regulation Act of 1985, as amended, (Section 163.3161
~ ~., Florida statutes (1995) and Rule 9J-5, Florida
Administrative COde, Minimum Criteria for Review of Local
Government Comprehensive Plans and Determination of Compliance,
require that in the event a local government considers and adopts
comprehensive plan amendments that such local government submit
those amendments to the Department of Community Affairs for review
and comment; and
WHEREAS, Collier County has prepared the following Amendment
of its Growth Management Plan:
Marco Island Master Plan Element
and has held pUblic hearings to provide for and encourage public
participation and comment throughout the plan amendment
prepa~tion process; and
WHEREAS, the Collier County Planning Commission has
considered the proposed Amendment to the Growth Management Plan
and has recommended approval of said plan amendment to the Board
ot County Commissioners; and
WHEREAS, Collier County must submit the proposed plan
amendments to the Department of Community Affairs for preliminary
review; and
WHEREAS, SUbsection 163.3184(6) (a), Florida Statutes),
Collier County may request that the Department of Community
Affairs review this proposed Growth Management Plan Amendment; and

WHEREAS, upon receipt of Collier County's proposed Growth
Management Plan Amendment, the Department of Community Affairs
must, within thirty (30) days, notify Collier County, in writing,
of its intention to conduct a review regardless of whether a
request for review has been made by the Southwest Florida Regional
Planning Council, any affected person or Collier County; and
WHEREAS, upon receipt of comments from reviewing government
agencies, the Department of Community Affairs shall have thirty
(30) days to review comments from the various qovernment agencies
and to transmit to Collier County its written comments regarding
the proposed plan amendment which include any objections and
recommendations for modifications; and
WHEREAS, Collier County, upon receipt of the written comments
from the Department of Community Affairs, must adopt or adopt with
changes the proposed Growth Management Plan Amendment within sixty
(60) days of such receipt; and
WHEREAS, the Department of community Affairs, within
forty-five (45) days of receipt of Collier County's adopted Growth
Management Plan Amendment, must review and determine if the Plan
Amendment is in compliance with the Local Government Planning and
Land Development Act of 1985, as amended; the state Comprehensive
Plan; the Southwest Florida Regional Policy Plan; and Rule 9J-5,
Florida Administrative Code:
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COl1NTY, FLORIDA, that;
The Board of County Commissioners hereby approves the
proposed Marco Island Master Plan Element as an amendment to its
Growth Management Plan for the purpose of transmittal to the
Department of Community Affairs and requests that the Department
review said plan amendment thereby initiating the required State
evaluation of the Growth Management Plan Amendment prior to final
adoption by the Board of County Commissioners and State

determination of compliance with the Local Government
Coapreheneive Planninq an4 Land Development Regulation Act of
1985, as amended, and Rule 9J-5, Florida Adminietrative Code, the
