Resolution 1996-205/CWS 96-5 APR 2 3 1996 RESOLUTION NO. 95- 205 RESOLUTION NO. CWS-95---1- RESOLUTION NO. MWS-95---1- RESOLUTION NO. GWD-95---1- RESOLUTION DIRECTING THE COUNTY ATTORNEY TO INSTITUTE FORECLOSURE ACTIONS ON DELINQUENT WATER AND/OR SEWER SPECIAL ASSESSMENTS. WHEREAS, the Board or county commissioners, as the Governing Body of Collier County, Florida, and as Ex-Officio the Governinq Board of the Collier County Water-Sewer District and ths Marco Water and Sewer District, has levied special water and/or sewer assessments against benefited properties within various utility special assessment districts; and WHEREAS, Section 153.73(11) (f), Florida statutes, provides that the Board ot County Commissioners as Ex-Officio the Governing Board ot the various Districts shall direct its attorney not later than thirty (30) days after the annual installments are due and payable to institute foreclosure actions on delinquent water and sewer special assessment liens, within two (2) months after such direction, to enlorce the collection of all special assessments tor assessable improvements made under said section and remaining due and unpaid; and WHEREAS, the utility special assessment districts annual installments are due and payable prior to and became delinquent on April 1, 1996; and WHEREAS, it is the duty of the District Board to enforce the prompt collection of all delinquent special assessments. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD'OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, THE MARCO WATER AND SEWER DISTRICT AND THE GOODLAND WATER DISTRICT, that: 1) All delinquent water and/or sewer special assessments are to be collected pursuant to Chapter 153.73, Florida statutes, by foreclosure" action in the Circuit Court of Collier County, Florida. 2) The County Attorney is hereby authorized and directed to 1 lOOK 000 p,'d84 . APR 2 3 1996 proceed within the next two (2) months to institute foreclosure actions in the circuit Court to enforce the collection of all delinquent special assessments for assessable improvements within the ~ollowinq Special Assessment Districts: Collier County Reqional Water AssessMent District No. 1 Willouqhby Acres Water Assessment District Willoughby Acres Sewer Assessment District Sewer Service Area "An Assessment District Davis Blvd. Water Assessment oistrict Marco Sewer Phase I Assessment District Marco Sewer Phase II Assessment District Goodland Water District 3) The County Attorney is also authorized and directed to make the necessary arrangements and obtain title reports for all properties with a delinquent special assessment within the aforementioned districts, the costs of the title reports and all other costs incurred in the foreclosure actions shall be paid by the Utilities Division and are subject to recovery in the foreclosure actions.
