Resolution 1996-151 HAR 2 6 1996 RESOLUTION NO. g6--1lUL A RESOLUTION BY TBB BOARD 07 COUNTY COMMISSIONERS 07 COLLIER COUNTY, ADOPTING A CITIZENS PARTICIPATION PLAN' AND COMPLAINT PROCEDURBS FOR GRIEVANCES FILED REGARDING SUBSTANDARD WORKMANSHIP AND\OR DISCRIMINATION IN HOUSING ON HOD ASSISTED CONTRACTS. WHEREAS, the Board of County Commissioners adopted Ordinance No. 90-60 on July 24, 1990 establishing the Citizens Advisory Committee as required by the Department of Community Affairs (DCA) to participate in the Community Development Block Grant program, WHEREAS, the DCA further requires the adoption of a Citizens Participation Plan which includes procedures for addressing complaints arising Housing on and Urban Development (HUD) projects, WHEREAS I staff has prepared the plan which includes complaint procedures to bring Collier County into compliance with the requirement. This is included as Attachment "A". BE IT FURTHER RESOLVED that this Resolution be recorded by the Official Clerk of Courts in the Public Records of Collier County, Florida. Weigel County Attorney docl8222jRCjd aOOK 000 PIG[ 158 ATTACHMENT "A" MAR 2 6 1996 CITIZEN PARTICIPATION PLAN COLLIER COUNTY COHMUNITY DEVELOPMENT BLOCK GRANT PROGRAM OVER>.LL GOAL Per the requirements of 24 CFR 570.431 and Rule 9B-43, Florida Administrative Code, the pUrpose of this Plan is to ensure an adequate opportunity for community-wide participation in the planning, development, implementation, and performance evaluation activities related to Collier County's Community Development Block Grant (CDBG) Program. OBJECTIVES A. To increase interchange of information between CDBG staff and the local citizenry concerning community development and related concerns. B. To heighten pUblic awareness as to the pUrpose and function of the CDBG prcgram and the types of assistance available, especially among low and moderate income residents of COBG targeted areas. C. To increase community participation in program planning and implementation, and thereby create local support for CDBG goals. D. Allows affected or assist in shaping their neighborhood potentially affected citizens to directly and guiding the program's impact upon as well as the community at large. CITIZENS ADVISORY TASK FORCE Due to the inherent necessity for continuous citizen involvement in the Community Development Block Grant Program in Collier County. the Board of County Commissioners, by Ordinance No. 90-60, established the CDBG Citizens Advisory Task Force to assist with program planning, implementation and assessment. The Task Force forms the central avenue through which ongoing citizen involvement and oversight is assured. Through this group, the County assures representation of varied segments of the community, inClUding low and moderate income program beneficiaries. All public hearings will be announced in the non-legal sectioJ1AR 261996' of the Naoles Oailv News a minimum of five (5) days, but not more than fourteen (14) days, prior to the scheduled hearing. The hearing will be advertised at least once during the period. To ensure accessibility, hearings will be held at the following locations: The Board of County Commissioners Room on the Third Floor of Building F, Collier County Government Complex, or in the designated "Community" facility within the Target Area(s) . ACCESS TO PUBLIC INFORMATION All program information will be available for inspection by interested citizens, including, at a minimum: COBG Advisory Task Force minutes, COBG Application COBG Program Regulations, Guidelines and Operating Procedures, Quarterly status Reports, and the Citizen Participation Plan. These documents are available during normal working hours (Monday through Friday from 8:00 a.m. to 5:00 p.m.) at the office of the Housing and Urban Improvement Department, currently located at 2800 North Horseshoe Drive, Naples, Florida 33942. This information will be available at no charge. In addition, specific information dissemination and technical assistance activities will be undertaken to inform the low and .moderate income persons residing in the CDBG Target Areas. Such activities include: neighborhood meetings at community centers, churches or other convenient locations, community outreach by CDBG staff, direct contact by Citizens Advisory County neighborhood representatives and written (flier type) information concerning the program. These activities provide excellent opportunities for interaction with those residents served by the program. Citizen views and recommendations are strongly encouraged. CITIZEN COMPLAINT PROCESS See Attachment l, Complaint Procedures. BILINGUAL OPPORTUNITIES According to the 1990 census, the foreign born population in Collier County is 15,903. Operational experience in the CDBG County has proven that the number of families speaking foreign languages is not significant. However, all advertisements for public hearings state that in a language interpreter will be provided if requested prior to the meeting. RESPONSE TO PROGRAM INOUIRIES All inquiries concerning the Collier County CDBG Program will be promptly answered, either by telephone, personal contact, or in writing. All written inquiries will be answered in writing. The response should not exceed fifteen (15) days from the date of receipt of the inquiry by the CDBG administrative office. 3 aOOK OOOpm161 ATTACHMENT 1 MAR 2 6 1996 I I It is the policy of the U. s. Department of Housing and Urban Development (HUD) , the Florida Department of Community Affairs (DCA), and the Collier County Board of County Commissioners to provide a means by which persons may file complaints of substandard workmanship and complaints of discrimination in housing on HUD assisted contracts. Therefore, it is the policy of the Board of County Commissioners to enforce nondiscrimination practices in program policy, procedures or performance and to assure quality workmanship. 1. Any person who feels that he/she has been discriminated against because of race, color, religion, sex, national origin, age or physical handicap, or has a complaint concerning qualify of workmanship should contact the Director of COllier County Housing and Urban Improvement Department, 2S00 North Horseshoe Drive, Naples, Florida 33942, phone number (941) 643-S330. 2. All complaints should be filed within forty-five (45) days of the alleged unlawful practice. COMPLAINT PROCEDURES 3. Upon receipt of the complaint, notice serviced in writing by certified mail, requested, upon the individual(s) and/or whom the complaint has been filed. 4. A fair and impartial investigation will be conducted by the appropriate party appointed by the County Manager, and within fifteen (l5) working days of the receipt of the complaint a written report of findings and determinations will be rendered. Proper notification of findings will be served upon the complainant and the respondent by certified mail. of same return company will be receipt against 5. Within ten (10) days after the service of said findings and determinations, either party may request a hearing if they are not satisfied. 6. An appeal of the local determination/decision should be filed by either party with the Director of the Bureau of Housing and Community Assistance, Florida Department of Community Affairs, no later than one hundred eighty (ISO) days after the occurrence of the alleged unlawful practice. ~OOK 000 PIG, 162
