Resolution 1996-149 MAR 2 0 1998 "SOLUTIO. .0. .6-14. RESOLUTION OF THE COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS OPPOSING THE LEGISLATIVE ENACTMENT OF HOUSE BILL 1955 AND SENATE BILL 1630, LIKITING THE l!XERCISE OF THE POWER OF EKINENT DOKAIN BY ANY KUNICIPALITY OR COUNTY GOVERNKENT IN COLLIER COUNTY IN CASES INVOLVING BEACH PARKS, BEACH ACCESS LANDS OR OTHER RELATED BEACH RECREATIONAL FACILITIES. WHEREAS, the Collier County Legislative Delegation held its advertised public hearing at the Collier County Government Center on January 19, 1996; and WHEREAS, a subject discussion before the Collier County Legislative Delegation was a proposal to enact legislation relating specifically to Collier County, providing for the limitation (express prohibition) of "the right of the the county government of Collier county to exercise the right of eminent domain to acquire fee title or any other rights or estates in lands for the purpose of establishing, operating or maintaining any beach park, beach access lands, or other related recreational facilities situated in whole or in part within any municipality in Collier CountY"i and WHEREAS, the Collier County Board of County commissioners Chairman, John C. Norris, addressed the Legislative Deleqation at its public hearing in Collier County, expressing Collier County's opposition to said proposal; and WHEREAS, the senatorial representatives of the Collier County Legislative Delegation expressed their intentions n2t to support the legislative proposal that now appears as Hou~e Bill 1955 and Senate Bill 1630; and WHEREAS, there now exists two (2) companion bills; House Bill 1955 and Senate Bill 1630, which propose to expressly prohibit Collier county government frcm exercising its statutory right of eminent domain for certain purposes within municipalities of the county which singles out Collier County government to expressly prohibit otherwise generally provided-for statutory rights pursuant to the Florida Constitution. 1 -I~4-1i MAR 2 0 1996 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1) The Board ot County Commissioners ot Collier County, Florida, strongly opposes the enactment of House Bill 1955 and Senate Bill 1630 during the 1996 LegiSlative seseion. 2) A certified copy of this Resolution be sent to each member of the Collier County Legislative Delegation.
