RESOWTION NO. 96- 139
RESOWTION FOR PETITION AV 95-011 TO VACATE
CERTAIN 20 FOOT ALLEYWAY AND PCRTIONS OF
CERTAIN CUL-DE-SAC RIGHTS-OF-WAY LOCATED ON A
PCRTION OF THE PLAT OF GOLDEN GATE UNIT 6, AS
RECORDED IN PLAT BOOK 5, PAGES 124-126, AND
PCRTION OF THE PLAT OF GOLDEN GATE UNIT 7, AS
RECORDED IN PLAT BOOK 5, PAGES 135-146, OF
THE PUBLIC RECORDS OF COLLIER COUNTY,
FLORIDA.
MAR 1 2 1996
WHEREAS, pursuant to Sections 177.101, 336.09 and 336.10,
Florida Statutes, Mike Landy, of Butler Engineering, Inc., a.
agent for owner, Avatar Properties, Inc., does hereby request the
vacation of certain 20 foot alleyways and portions of certain
cul-de-sac rights-ot-way located on a portion of the plat of
Golden Gate Unit 6, as recorded in Plat BOOK 5, Pages 124-126,
and a portion of the plat of Golden Gate Unit 7, as recorded in
Plat Book 5, Pages 135-146, of the Public Records of Collier
County, Florida; and
WHEREAS, the granting of the vacation will not adversely
affect the ownership or right of convenient access of other
property owners; and
WHEREAS, the petitioner is requesting vacation of the public
ingress/egress rights to the 20 foot alleyway, but the public
shall retain the public utility and drainage rights with no
maintenance responsibility by Collier County, Florida; and
WHEREAS, the vacation and abandonment of the 20 foot

alleyway on a portion of the plat of Golden Gate Un! t 6, as
recorded in Plat Book 5, Pages 124-126, and a portion of the plat
of Golden Gate Unit 7, as recorded in Plat Book 5, Pages 135-146,
of the Public Records of Collier County, Florida,' would benefit
the general public welfare and is in the best interest of the
public in the following particulars:
1. Petitioner agrees to clear and maintain the alley area
improving aesthetics.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMllISSIONERS OF COLLIER COUNTY, FLORIDA, that the following be
