A RESOLUTION SPLITTING THE WATER SPECIAL ASSESSMENT
FOR ACCOUNT NO. 119506 LOCATED WITHIN THE COUNTY
REGIONAL WATER ASSESSMENT DISTRICT NO. 1 (PROJECT
NO. 38000).

WHEREAS, the Board of County Commissioners as the Governing
Body of Collier County and as EX-Officio the Governing Board of
the Collier County Water-SelJer District on June 18, 1985 adopted
Resolution No. CWS-85-4A confirming the preliminary assessment
roll for the construction of the potable water improvements within
the County Regional Water Assessment District NO.1; and
WHEREAS, Resolution No. CWS-85-4A provided for the levy of
the water special assessment on the benefited properties within
the County Regional Water Assessment District No.1; and
WHEREAS, the water special assessment in the total principal
amount of $104,523.05. Account No. 119506, was levied on a parcel
of land located within Section 34, Township 50 South, Range 26
East, identified by Parcel Folio No. 00447920002, with a total
front footage of 5,772.33 front feet; and
WHEREAS, the property owner has made the annual water
assessment payments on the above described property through
November, 1994; and
WHEREAS, Southern States utilities, Inc. filed an eminent
domain proceeding in Circuit Court to condemn a portion of the
above described property and the Circuit Court entered a
Stipulated Order of Taking on June 27, 1994 for said case (Case
No. 94-0793-CA-OI-CTC) and said Stipulated Order of Taking is
recorded in OR Book 1963, Pages 1558-1565, of the Official Records
of Collier County, Florida; and
WHEREAS, as a result of the Stipulated Order of Taking, the
property owner (Lamar Gable, Trustee), under Account No. 119506
was left with only 1,068.63 front feet; and
WHEREAS, a written request has been made to the County by
Lamar Gable, Trustee, to have this water special assessment split

into two (2) accounts.
NOW, TREREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE
COLLIER COUNTY WATER-SEWER DISTRICT, that:
1) Account No. 119506 for the County Regional Water
Assessment District No. 1 (Project No. 38000) that has a principal
balance as of November 1, 1994 of $52,261.55 and with an existing
front footage as of June 27, 1994 of 1,058.53 front feet is hereby
approved to be adjusted on the County Regional Water Assessment
District No. 1 assessment roll. The County Regional Water
Assessment District No. assessment roll for Account No. 119506
shall be reduced to reflect the principal balance of $9,573.61
with interest accruing thereon from November, 1994 at the rate of
8.5 percent per annum. A revised bill shall be immediately mailed
to the property owner, Lamar Gable, Trustee, 2600 Golden Gate
Parkway, Suite 200, Naples, Florida 33942.
2) A new account number shall be created on the County
Regional Water Assessment District No. 1 (Project No. 38000)
aseessment roll for remaining portion of the property (Folio No.
00448000303). The legal description of the property shall be the
property described in the Stipulated Order of Taking recorded in
OR Book 1953, Pages 1558-1555, of the Official Records of Collier
County, Florida. The new account number shall show the principal
amount of $42,587.94 as of November, 1994 with interest accruing
thereon at the rate of 8.5 percent per annum for'the total front
feet of 4,703.70. A bill shall be immediately mailed to the
property owner of this new account, Southern States utilities,
Inc., 1000 Color Place, Apopka, Florida 32703.
3) The special water assessment was levied in accordance
with Chapter 153, Part II, Florida Statutes, and constitute a lien
upon the property identified as Folio No. 00448000303 and Folio
No. 00447920002. The special water assessment is of the same

nature and to the same extent as the liens on said properties for
County ad valorem taxes and shall be collected in accordance with
Chapter 153, Part II, Florida statutes.
4) A certified copy of this Resolution shall be provided to
the Collier County Department of Revenue and the Collier county
Department of Revenue shall immediately take those actions as
contained herein.
5) A certified copy of this Resolution shall be mailed to
the two property owners with the revised bills. The revised bills
shall be mailed with a letter stating that these bills will be
delinquent on April 1, 1996 and may be subject to foreclosure
action if not immediately paid.
5) This Resolution shall be recorded in the Official Records
of Collier County, Florida.

KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY
COMMISSIONERS' OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE
COLLIER COUNTY WATER-SEWER DISTRICT, were the owners and holders
of a the East and South Naples sanitary Sewer Special Assessment
Lien against:

The Lien (Resolution No. 92-345) was recorded on the 1st day
of July, 1992, in Official Record Book 1730, Page 1711, of the
Official Records of Collier County, Florida. The Sewer Special
Assessment Lien for East and South Naples Sanitary Sewer District
1 secures the principal sum of Three Thousand One Hundred
Seventy-eight Dollars and Seventy-nine Cents ($3,178.79) plus
accrued interest and penalties, if any, and imposes certain
obligations against real property situated in Collier County,
Florida, described as follows:
Lot 9, Block 5, Avalon Est. Unit 1, OR Book 1954,
Page 1391, Project No. 51000, Account No. 213510,
Folio No. 22624280103
Collier County, a political SUbdivision of the State of Florida,
and the Collier County Water-Sewer District, a body corporate and
politic, do hereby acknowledge receipt of payment in full
satisfaction of the Lien and hereby cancels the Lien.
The Clerk of the Circuit Court is hereby directed to record this
Satisfaction of Lien in the Official Records of Collier County,
Florida, to acknowledge that the Lien ceases to exist.
IN WITNESS WHEREOF, the Board of County Commissioners of Collier
County, Florida, as the Governing Body of Collier County and as
Ex-Officio the Governing Board of the Collier County Water-Sewer
District, acting through its Chairman, directs execution and
