CWS-U-.L- A RESOLUTION AUTHORIZING THE ACQUISITION BY GIFT, PURCHASE OR CONDEMNATION OF NON-EXCLUSIVE, PERPETUAL UTILITY EASEMENTS FOR THE CONSTRUCTION OF WATER WELL SITES REQUIRED TO REPLACE AND RESTORE TWO (2) WELLS IN TIlE GOLDEN GATE WEIjLFIELD THAT HAVE BECOME INOPERABLE FOR THE COLLIER COUNTY WATER-SEWER DISTRICT. " WHEREAS, the Golden Gate Wellfield is presently the sole source of raw water for water treatment facilities which provide potable water to customers in the Collier County Water-Sewer District Water service Area: and WHEREAS, the Golden Gate Well field consists of 27 wells of which two wells are inoperable and need to be restored to provide adequate reserve capacity: and WHEREAS, the County Staff has evaluated alternative locations, reviewed the environmental factors, considered the cost variables, ond analyzed the safety and welfare considerations as they relate to thG acquisition of the non-exclusive perpetual utility eascrn~nts identif,ed and described in Exhibit "A", attached hereto, as the i,' ,>ropriate locations for the two (2) replacement wells: and WHEREAS, it has been recommended by County Staff that the non-exclusive, perpetual utility easements as described in Exhibit "A", attached hereto and incorporated herein, are the most feasible locations to restore and replace certain water wells; and WHEREAS, the staff has rece'rnrnended that it is necessary and in the best interest of Collier County, Florida, and the Collier County Water-Sewer District, to acquire certain non-exclusive, perpetual utility easements which are required and necessary for the construction of these two (2) water wells in the Golden Gate Wellfield; and : WHEREAS, the expeditious acquisition of non-exclusive, perpetual, utility easements for the permanent water well sites are of paramount' '/:. importance to tho completion of this utility project as scheduled: and ,~ 0-:: -Page 1- , .~'OO,._w,,'"___.~__._"~,__._-- .~ ~ ,', " FEB - 6 1996 ", w WHEREAS, the design and construction of said utility improvements related facilities have been determined by the Board of County i '-~: i ,. ; ';and Commissioners, as the Governing Body of Collier County and as Ex-Officio the Governing Board of the Collier County Water-Sewer District of Collier County, to be necessary and in the best interest of Collier County; and WHEREAS, the construction to restore and replace certain water wells in the Golden Gate Well field is necessary in order to protect the health, safety and welfare of the citizens of Collier county and is in the best interest of Collier County, and will assist the Collier county Water-Sewer District in meeting water supply requirements. NOW, THEREFORE, BE IT RESOLVED BY TIlE BOARD OF COUNTY COMMIS- SIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO TIlE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, that it has been determined by the Board thnt the construction of two (2) water wells in the Golden Gate Wellfield to replace two (2) wells (hereinafter referred to as the "Project") is necessary as a public purpose and is in the best interest of Collier County and the Collier County Water-Sewer District. AND IT IS FURTHER RESOLVED that the Board has revi..!d the Statf analysis regarding alternative location, environmental 1lctorl, cost variables, safety and welfare consideration as they rela;,~ to the construction of the project and finds that the most feasible locations for the certain non-exclusive, perpetual utility easements are described in Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTIlER RESOLVED that the construction and maintenance of the utility improvements for the well facilities are compatible with the long range planning goals and Objectives of the Collier County Water-Sewer District. AND IT IS FURTHER RESOLVED that to implement said construction of the project it is appropriate and necessary for the Board to acquire certain non-exclusive, perpetual utility easements as described in the attached Exhibit "A", attached hereto and incorporated herein, which are necessary for the construction to restore and replace the two (2) vater wells in the Golden Gate Wellfield. -Page 2- ,"""'.............__."...._-~~'--"- FEB - 6 1996 AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acquire by gift, purchase or condemnation in accordance with the provisions of Chapters 73, 74 and l27, Florida statutes, the certain non-exclusive, perpetual utility easements being more particularly described in Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that no mobile homes are located on the property Bought to be acquired and therefore it will not be necesBary to remove any mobile homes from the property to be acquired.
