RESOLUTION NO. 96- 34
RESOLUTION AUTHORIZING FINAL ACCEPTANCE OF THOSE
ROADWAY, DRAINAGE, WATER AND SEWER IMPROVEMENTS IN
HEERS SUBDIVISION, R!:LEASE OF THE MAINTENANCE
SECURITY, AND ACCEPTING THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY, DRAINAGE, WATER AND
SEWER IMPROVEMENTS THAT ARE NOT REQUIRED TO BE
MAINTAINED BY THE HOMEOWNERS ASSOCIATION, OR THE
IMMOKALEE WATER/SEWER DISTRICT.
WHEREAS, the Board of County Commissioners of Collier County,
?lorida, on August 10, 1993, approved the plat of Heers Subdivision
for recording; and
WHEREAS, the developer has constructed and maintained the
~oadway, drainage, water and sewer improvements in accordance with
,he approved plans and specifications and as required by the Land
Jevelopment Code (Collier County Ordinance No. 91-102, as amended);
and the utilities Standards and Procedures Ordinance (Collier
county Ordinance No. 88-76, as amended), and
WHEREAS, the developer has now requested final acceptance of
~he roadway, drainage, water and sewer improvements and release of
:,is maintenance security; and
WHEREAS, the Compliance Services Section of Development
'crvices Department has inspected the roadway, drainage, water and
:ewer improvements and is recommending acceptance of said
"acUities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance be
granted for those roadway, drainage, water and sewer improvement',<,
in Heers SUbdiViSion, and authorize the Clerk to release the
maintenance security.
BE IT FURTHER RESOLVED AND ORDERED that the Co,e;:ty accept thG
uture maintenance and other attendant costs for th. roadway,
rainage, water and sewer improvements that are not !.'equired to be
;.laintained by the homeowners ansociation.
This Resolution adopted after motion, second and majority vote
favoring same.
