Resolution 1996-015 JAil - 9 1996 I I , , RESOLUTION, 96-~ A RESOLUTION PROVIDING FOR THE ESTADLISHMF.NT 01' AN AUTO SALVAGE YARD CONDITIOtlAL USE IN THE "I" ZONING DISTRICT PURSUANT TO SECTION 2.2.16.3.20 OF THE COLLIER COUNTY u~ID DEVELOPMENT CODE FOR PROPERTY LOCATED IN' SECTION 18, TOWNSHIP 51 SOUTH, RANGE 27 EAST, COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature ot the State ot FlorIda in Chapter 67-1246, Laws ot Florida, and Chapter 125, Florida Statutes, has conterred on Collier County the power to establish, coordinate and enforce zoning and such business regulations as arll necessary tor the ., i I protection ot the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) which includes a Comprehensive Zoning Ordinance establishing regulations tor the 30ning ot particular geographic divisions ot the County, among which ill the granting ot Conditional Uses; and , , I I I I I I I , , , I , WHEREAS, the Collier County Planning Commissi"n, being the duly appointed and constituted planning board tor the area hereby attected, has held a public hearing after notice as in said regulations made and provided, and has considered the advisability of C"nditional Use 2.2.16.3.20 in an "I" zone for an auto salvage yard on the property hereinatter described, and has tound as a matter ot tact (EXhibit "1\", that satistactory provision and arrangement have been ml..e conCernill9 all applicable matters required by said regulation" and In accordance liith Subsection 2.7.4.4 ot the Land Development Code tor the Collier , ! County Planning Commission; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in a pUblic meeting assembled, and the Board having' considered all matters presented. NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING APPEALS of Collier County, Florida that, The petition tiled by Robert S. Hall ot Pine Ridge Auto Parts' Sales Inc. with respect to the property hereinatter described an- Exhibit "B" which is attached hereto and incorporated by reference herein. be and the same is hereby approved tor a Conditional Use per Section 2.2.16.3.20 ot the "I" zoning district tor an auto salvage yard in accordance with the Conceptual Master Plan (Exhibit "CO) and subject to the tollowing conditions'oO -1100~ 0 PAr., -/0 ~',-~. ~; JAM - 9 1198 The planning , Technical Services Manager may approve alnor changes in the location, siting, or height ot buildings, structures, and improvements authorized by the conditional use. Expansion ot the uses identified and approved within this conditional use application, or major changes to the site plan submittal ot a new conditional use application, shall comply with all applicable countr ordinances i,n etteot at the time ot submittal, including Div sion 3.3, site Development Plan Review and approval, ot the Collier County Land Development Code (LOC), Ordinance No. 91-102. b. In addition to the required landscaping per Division 2.4 of the LDC, a seven (7) toot high opaque tence or wall, shall be installed with the tinished side out around the perimetsr of the subject property. a. c. storage and stacking ot vehicles, automobile parts, motors, frames and general merchandise above the proposed seven (7) foot fence height is prohibited throughout the subject property, except within an enclosed buil,Hng. d. Since the private access road is concret.. u~ to the Krehling concrete plant, the petitioner shall be required to provide a dustless surface from the terminus ot the concrete aCCess road to the subject site. e. Metal shredding shall be prohibited on-site. t. Hours ot operation shall be from 7:00 a.m. to 7:00 p.m. g. Intermediate automobile cruShing/compacting shall be provided on-site by others, with a portable automobile crusher, between the hours ot 9'00 a.m. and 6'00 p.m. h. Attack dogs shall be prohibited on-site. BE IT FURTHER RESOLVED that this Resolution be recorded in the ninutes of this Board.
