CWS-96-~_ JAN - 9 1996 A RESOLUTION AUTHORIZING TilE ACQUISITION BY GIFT, PURCHASE OR CONDEMNATION OF NON-EXCLUSIVE, PERPE!~AL UTILITY EASEMENTS AND TEMPORARY CONSTRUCTION EASEMENTS FOR THE CONSTRUCTION OF WATER PIPELINE AND WATER WELL SITES REQUIRED E'OR THE COLLIER COUNTY WATl!:R-SEWER DISTRICT'S NORTH COLLIER RE:GIONAL WATER TREATMENT PLANT EXPANSION PROJECT. WIIEREAS, on April 11, 1995, the Board of County Commissioners as the Governing Body of Collier County and as Ex-Officio the Governing Board of the Collier county Water-Sewer District of Collier county, Florida (the "Board"), authorized staff to proceed with the expansion plans: and the Board entered into an engineering contract with Metcalf and Eddy, Inc., to provide the professional services related to an eight million gallon per day (8-MGD) expansion and associated improvements to the North Collier Regional Water Treatment Plant; and WIIEREAS, the improvementG are consistent crE 859 and crE 865, North Collier Regional Water Treatment Plant Expansion Project to meet the increasing demands in the north service area of the County; and WIIEREAS, the County Staff has evaluated alterna'tive locations, reviewed the environmental factors, considered the cost variables, and analyzed the safety and welfare considerations as t,hey re ate to the acquisition of the non-exclusive perpetual utility easem,nts and the temporary construction easements and it has been re,commended by County Staff that the non-eXClusive, perpetual utility easements and the temporary construction easements as described in E):hibit "A", attac~ed hereto and incorporated herein, are the most feasible locations to construct the water pipelines and water wells as p~rt of the North Collier Regional Water Treatment Plant Expansion Project; and WHEREAS, the staff has recommended that it is necessary and in the best interest of Collier County, Florida, to acquire certain non-exclusive, perpetual utility easements and temporary construction easements which are required and necessary for the construction of the water pipeline and water well site improvements for the North Collier Regional Water Treatment Plant Expansion Project: nnd _1'"1........,.. 1 n('\n ......'" . '~ ~ ~ ,~ dl ~I 1 'I....~ i<; , WIIEREAS, the expeditious acquisition of non-exclusive, perpetual utility easements and temporary construction easements for the wat~r of paramount importance to '~~I .,-. ~ ~I ': 'JI ,:~i '1 j~ ,i ,i~, WllEREASi the design and construction of said utility improvements related facilities have been determined by the Board of County as the Governing Body of Collier County and as Ex-Officio the Governing Board of the Collier County Water-Sewer District of Collier County, to be necessary and in the best interest of Collier County; and WIIEREAS, the construction of the water pipeline and water well site improvements for the North Collier Regional Water Treatment Plant Expansion Project is necessary in order to protect the health, safety and welfare of the citizens of Collier County and is in the best interest of Collier County, and will assist Collier County in meeting certain concurrency requirements of the Growth Manllgement Plan for Collier County. , .! NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- SIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO TilE GOVERNrNG BOARD OF THE: COLLI':R COUNTY f'J '!i ,~ ~ 'I j '5 WATER-SEWER DISTRICT, that it has been determined by the 30ard that the construction of the water pipeline and water wells along Vanderbilt Beach Road Extension from the North Collier Regiona,l Water Treatment Plant site easterly to 17th Street for the North Collier Water Treatment Plant Expansion projact (hereinafter referred to as the "Project") is necessary for a public purpose and is in the best interest of Collier County. . ~ 1 AND IT IS FURTHER RESOLVED that the Board has reviewed the Staff analysis regarding alternative location, environmental factors, cost variables, safety and welfare consideration as they relate to the construction of the Project and finds that the most feasible location for the certain non-exclusive, perpetual utility easements and -Page 2- nnn -, ?" temporarJ construction easements are described in Exhibit "An, attached herGto and incorporated herein. AND IT IS FURTHER RESOLVED that the construction and maintenance the utility improvements for the related water :pipeline and water well facilities are compatible with the long range planning goals and :objoctives of the Collier County Water-Sewer District. AND IT IS FURTHER RESOLVED that to implement said construction of the Project it is appropriate and necessary for the Board to acqui,re a certain non-exclusive, perpetual utility easements and temporary construction easements described in the attached Exhibit "A", attached hereto and incorporated herein, which are necessary for the construc- tion of the water pipelines and water wells for the North Collier Regional Water Treatment Plant Expansion Project. AND IT IS FURTHER RESOLVED that the County staff is hereby authorized to immediately acquire by gift, purchase or condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida statutes, the certain non-exclusive, perpetual utility easements and temporary construction easements being more particularly described iI, Exhlbit "A", attached hereto and incorporated herein.
