RESOLUTION 89-~
A RESOLUTION ESTABLISHING THE AMOUNT OF OUTSIDE
CONSULTANT AND LEGAL SERVICES INCURRED IN CONNECTION
WITH THE PROCESSING AND EVALUATION OF TELESAT, INC.'S
CABLE FRANCHISE APPLICATION, PROVIDING FOR REIMBURSEMENT
OF THIS AMOUNT TO THE COUNTY BY TELESAT, INC.; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Tel..at Cablevision, Ine. ("Telesat") applied tor
a franchise to provide cable television service to residents ot
Collier County ("County"); and
WHEREAS, in order to a.Bure that residents ot the county
enjoy any benetit. of competition in the provision of cabl.
television services, The Board of County Commissioners
("Board") on Kay 30, 1989 awarded Telesat a tranchise to
provide cable television service to residents of the County,
SUbject to the negotiation ot a franchise agreement; and
WHEREAS, the Board received notification on August 8, 1989
from Tele.at that it had decided to withdraw it. application
tor a franchi..; and
WHEREAS, the withdrawal of Telesat'. tranchi.. application
terminated the negotiation proce8s undertaken by the County and
the Telesat cable tranchise application is no lonqer pendinq
betore the Board; and
WHEREAS, pursuant to Section 3.4 ot the Collier County
Cable Television Franchise ordinance ("Ordinance") the Board 1s
entitled to recover trom Telesat reimbursement ~o the county ot
all costs ot processing and evaluating its application in
excess of the $10,000.00 application fee determined by the
Board to be nsc...ary for the proper evaluation of the
application; and
WHEREAS, the County has incurred costs in the amount ot
$42,514.13 (Forty-two Thousand Five Hundred Fourteen and 13/100
dollars) tor outside consultant and legal services in
connection with the processing and evaluation ot Telesat'.

WHEREAS, $32,514.13 (Thirty-two Thousand Five Hundred
Fourteen and 13/100 dollars) are in excess of the
non-refundable $10,000.00 application fee aubmitted by Talesat
with its franchi.. application;
NOW, THEREFORE, BE IT RESOLVED, by the Uoard of County
commissioner. of Collier County, Florida that:
1. The extraordinary costs in the amount of $32,514.13
(Thirty-two Thousand Five Hundred Fourteen and 13/100 dollars)
incurred by the County were necessary for the proper evaluation
of Telesat'. tranchi.. application.
2. Pursuant to Section 3.4 ot the Ordinance, Tel..at i.
required to reimbur.. the County tor all such nec...ary cost.
in excess of its $10,000.00 application tee.
3. This Resolution shall become effectiVe on August 22 ,
1989.
