Resolution 1989-212 AUGUST 22. 1989 RESOLUTION 89-111 RELATING TO PETITION NO. PU-88-10C FOR EXTENSION OF PROVISIONAL USE OF PROPERTY HEREINAFTER DESCRIBED IN COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature ot the State ot Florida in Chapter 125, Florida statutes, has conferred on all Counties in Florida the power to ..tablish, coordinate and entorce zoninq and .uch business regulations 88 are necessary tor the protection at the public; and WHEREAS, the County pursuant thereto has adopted a Comprehensive Zoning Ordinance establishing regulations tor the zoning ot particular divisions ot the County, among which is the qranting and extending the time period ot provisional Uses; and WHEREAS, on September 27, 1988, the Board ot County commissioner. enacted R..olution No. 88-225, which qrante4 a provisional use pursuant to Ordinance 82-2, for Provisional Use "g" ot the RSF-4 district tor cluster housing, on the below described property; and WHEREAS, Section 13, Paragraph 1, Subsection E provides that the Board of Zoning Appeals may grant an extension at the one (1) year time period for a provisional use which haa not been commenced; NOW, THEREFORE BE I~ RESOLVED, by the Board of Zoning Appeals of Collier County, Florida that the written request of Mr. Robert E. stowers, in interest ot the fallowing described property: The East 1/2 of the Southwest 1/4 of the Southwest 1/4 of the Northeast 1/4 and also the West 1/2 of the Southeast 1/4 of the Southwest 1/4 of the Northeast 1/4 of Section 23, TownShip 49 South, Range 25 East, Collier County, Florida. Less the North 30.00 feet for road right-of-way. is hereby approved pursuant to Section l3.l(e}, Ordinance No. 82-2, and the expiration date for the provisional Use "9" of the 9~a.o...lff/ -1- 00037 AUGUST 22, 1989: RSF-4 Zoning Dintrict tor cluster housing is hereby extended tor one year until ~Qpt.mb.r 27, 1990. BE IT FURTHER RESOLVED that this resolution be recorded in the minutes ot this Board and in the records ot the Petition tor which the extension i. granted.
