A RESOLUTION BY TilE BOARD OF COUNTY
CO~IMISSIONERS OF COLLIER COUNTY,
FLORIDA TO TilE STATE OF FLORIDA,
DEPARTMENT OF ENVIRONMENTAL
PROTECTION, GIVING ASSURANCES TIlA T TilE
T-GROIN PROJECT ALONG IIIDEAWAY BEACIl
WILL BE CONDUCTED IN ACCORDANCE WITII
TilE DEP PER~IIT.
WHEREAS, in May 1997, Permit No. lCP 112934539 is expected to be
approved by the Florida Department of Environmental Protection (DE?); and
WHEREAS, this permit will allow Collier County to construct 5 TMgroins
along Hideaway Beach on Marco Island; and
WHEREAS, the permit will contain a permit condition requiring the County
to provide wrillen assurance that the project will be conducted in accordance
with the permit and plan as approved by Ihe DEP; and
WHEREAS, Collier County is willing to accept the permit subject 10 the
aforementioned condition and is willing to give the requested assurance.
NOW, THEREFORE. BE IT RESOL VED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Section I. The County assures the DEP that the project will be conducted
in accordance with the monitoring and adjustment or removal requirements as
approved by the DEP.
Section 2. The County commits itself to removing the project, if required
to, and to restoring any damaged areas to pre-installation conditions, jf
necessary, at the County's own expense.
Section 3. The County agrees 10 hold the State of Florida and the DEP
harmless from any liability associated with this project, to the exfent allowed by
Florida law.

Section 4. This Resolution shall take effect immediately upon adoption.
