A RESOLtrl'ION BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
PURSUANT TO SECTION 2.7. 3 . 4 OF THE COLLIER
COUNTY LAND DEVELOPMENT CODE AFFECTING
ORDINANCE 88-50 ALSO KNOWN AS THE GADALETA
POD, REQUIRING THE SUBMITTAL OF A POD
AMENDMENT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Gadaleta POD, Ordinance 88-50, as amended, originally
adopted on May 24, 1988, is subject to the provisions of Section
2.7.3.4., of the Land Development Code (LDC), Time Limits for Approved
POD Master Plans; and
WHEREAS, the Board of County Commissioners has reviewed the POD
and has determined that the current POD Zoning is inconsistent with
certain provisions ,of the Growth Management Plan (GNP) and the Land
Development Code; ~nd
NOW, THEREFORE BE IT RESOLVED, by the Board of Zoning Appeals of
Collier County, Florida that:
1. The above recitals are adopted herein by reference as if
fully set forth herein.
2. This Resolution shall constitute evidence of compliance
with the review requirements of Section 2.7.3.4 of the
LOC.
3. Pursuant to. said section of the LOC, the property owner
or agent shall submit an amended POD to the Planning
Services Director prior to July 18, 1997 in order to
cause said POD to become consistent with the Collier
County GMP.
This Resolution shall become effective immediately upon its
approval.
BE IT FURTHER RESOLVED that this ReSOlution be recorded in the
ainutes of this Board and in the records of the Petition for which the
extension is granted.
