A RESOLUTION BY THB BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
PURSUANT TO SBC'l'ION :2.7.3.4 OF THB COLLIER
COUNTY LAND DEVELOPMENT CODI AFFBC'l'ING
ORDINANCE 89-95 ALSO DOWN AS BREEZElfOOD
PtlD, REPEALING RESOLUTION 96-516 AND
REQUIRING THB SUBMITTAL OF A POD AMENDMENT;
AND PROVIDING AN BFFBC'l'IVB DATB.
WRBRBAS, the Breesewood POD, Ordinance 89-45, adopted on Deceaber
1t, 1989, is subject to the provisions of section 2.7.3.4., of the Land
Devalopaant COde (LDC), Ti.e Limits for Approved PUD Kaster Plans; and
HHBRBAS, the Board of County Commissioners has reviewed the POD
and bas determined that the current POD Zoning ie inconsistent with
certain provisions of the Growth Kanage.ent Plan (GNP) and the Land
Development Code; and
WRBRBAS, a st~ff error re.ulted in the approval of Resolution
t6-516, vbich exterlded the POD approval to NovGaber 19, 1998; and
NOW, THEREFORE BB IT RESOLVED, by the Board ot Zoning Appeals ot
COllier county, Florida that:
1. Resolution 96-516 is hereby repealed and superceded by
Re.olution 97-~.
2. The above recitals are adopted herein by reference as it
fully set forth herein.
3. This Resolution shall constitute evidence of compliance
with the review requirements of Section 2.7.3.4 of the
LDC.
4. Pursuant to said section ot the LOC, the property owner
or agent shall submit an amended POD to the Planning
Services Director prior to Kay 19, 1997 in order to
cause said POD to become consistent with the Collier
County GMP.
This Resolution shall become eftective immediately upon its
