A RESOLUTION BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
PURSUANT TO SECTION 2.7.3.4 OF THE COLLIER
COUNTY LAND DEVEI,oPXENT CODE AFFECTING
ORDINANCE 90-45 ALSO KNOWN AS BEACHWAY POD,
EXTENDING THE CURRENT POD APPROVAL TO
NOVEMBER 19, 1998; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Beachway PUP, Ordinanc~ 90-45 adopted on June 6,
1990, is subject to the provisions ot Section 2.7.3.4., ot the Land
Develop_nt Code (LDC), Time Limits for Approved POD Zoning D1etricts
togeth.r with thei~ respective Master Plans; and
W,BEREAS, the POD was adopted consistent with and under th6
provisions ot the Collier County Growth Management Plan; and
W,KEREAS, the Board of County Commissioners has reviewed the POD

and hall determined 'to extend the current POD Zoning tor two years,
until November 19, 1998; and
NOW, THEREFORE BE IT RESOLVED, by the Board ot Zoning Appeals ot
Collier County, Florida that:
1. The above recitals are adopted herein by reterence as 1t
fully set forth herein.
2. This Resolution shall constitute evidence ot compliance
with the review requirements of Section 2.7.3.4 of the
LDC.
3. Pursuant to said section of the LDC, the current POD
approval is hereby extended to November 19, 1998; at the
end of which time the owner shall submit to the
procedures in LDC Section 2.7.3.4.
~li. Resolution shall become effective immediately upon its
