WHEREAS, the flDRID<\ DEPARIMrnT OF 'IPJ\NSroRTA'l'IQN requires the control
of, ard jurisdiction over the use of lards designated as Parcel No. 117 and
described in Exhibit "A", attachc:::l. hereto mu incotp:lrated herein, for the
four-lane construction am. maintenance of State Road 5-951, an authorize:i
State read, in acx::ordance with an agreement between the B:::oard of County
Cormtissioners, Collier Co.mty, Florida, hereinafter calle:l 11c::tJNI'Y1l, and the
State of Florida Cerarbrent of Trans{XIrtation, in which CCUNI"i is authorized
to acquire the right-of-WLlY for said road construction am maintenance; ard
WHEREAS, a portion of the lards necessary to said road construction ard
maintenance is ClWT'Ied by the Trustees of the Internal Imprcuerrent Tnlst Furrl of
the State of Florida, hereinaftel" called IrTRUST'EESll; arrl
WHEREAS, on behalf of o:xJNI'Y, a request has l:een node for the TRUSTEFS to
conve'~' the lards described. in Exhibit "All to the FLORI[YI. DEPARIMENI' or
TRANSFORrATION for Statr> Road 5-951 Right-of-Way; and
WHEREAS, a fair markc_ value real estate awraisal of the lan:ls dascri.bed
in Exhibit "A" has been prepara:i by o::x.JNI'Y, and the dollar amount of said
appraisal is offered to the mlS'I'EES, as cnrpcnsation for said larrls.i
tm, 'THEREFORE, BE IT RESOLVED that the Board of Coonty Ccmnissioners,
Collier Ccw1ty, Florida, (c:cx.MI'Y) hereby formally requests the Trustees of the
Internal IJrprovernent Trust F\.in::l. of the State of Florida ('IRJSTEES) to grant,
an easement for road right-of-way to the FlDRIDi\ DEPARIME1rr OF TRANSFORl'ATIOO
up:Jn those lards described in Exhibit 'W' (State Road 5-951, Parcel 117) for
the SLm\ of 'lHIRIY FCUR nlCXJSAND NINE HtJNI::RED OOUARS ($34,900).
