RESOLUTION DIRECTING THE COUNTY ATTORNEY'S OFFICE
TO INSTITUTE FORECLOSURE ACTIONS ON DELINQUENT WATER
AND SEWER SPECIAL ASSESSMENTS.
WHEREAS, the Board of County Commissioners, as the Governinq
Body of Collier County, Florida, and as Ex-Offlcio the Governinq
Board of the Collier County Water-Sewer District, the Goodland
Water District, and the Marco Water and Sewer ?istrict, has
levied special water and/or sewer assessments aqainst benefited
properties within various utility assessment districts, and
WHEREAS, Section 153.73(11l(fl, Florida Statutes, provides
that the Board of County Commissioners as Ex-Officio the
Governinq Board of the various Districts shall. direct its
attorney not later than thirty (30) days after the annual
installments are due and payable to institute foreclosure actions
on delinquent water and sewer special assessment liens within two
(2) months after such direction, and
WHEREAS, the utility special assessment districts annual
installments are due and payable prior to and became delinquent
on April 1, 1989/ and
WHEREAS, it is the duty of the District Board to enforce the
prompt collection of all delinquent special assessments.
NOW, THEREFORE, BE IT RESOLVED BY THE B01\RD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY
OF COLLIER COUNTY AND EX-OFFICIO THE GOVERNING B01\RD OF THE
COLLIER COUNTY WATER-SEWER DISTRICT, MARCO WATER AND SEWER
DISTRICT AND GOODLAND WATER DISTRICT, that:
1. All delinquent water and/or sewer special assessments
are to be collected pursuant to Chapter 153.73, Florida Statutes,
by foreclosure action in the Circuit Court of Collier County,
Florida.
2. The County Attorney's Office is hereby authorized to
proceed within the next two (2) months to institute foreclosure
actions in the Circuit Court to enforce the collection of all

delinquent special assessments for assessable improvements within
the following Special Assessment Districts:
Youth Haven Water Assessment District
Collier County Regional Water Assessment District No. 1
Willoughby Acres Water District
Willoughby Acres Sewer District
Palm Springs Water District
Sewer Service Area "A"
Blue Heron Lake Park Water District
Trinity Place Water District
Goodland Water District
Marco Sewer Phase I
Marco Sewer Phase II
3. The County Attorney's Office is alr.o authorized to make
the necessary arrangements and obtain title reports for all
properties with a delinquent special assessment within the
aforementioned districts, the costs of the title reports and all
other costs incurred in the foreclosure actions shall be paid by
the Utilities Division and are subject to recovery in the
foreclosure actions.
This Resolution adopted after motion, second and majority
vote.
